Anyone ever been done for less than 35 in a 30 zone?
Just checking out some information I was given from a (perhaps not so) reliable source that you cannot be prosecuted for less doing less than: 'the speed limit + 2mph + 10% of the speed limit' (eg cannot be done for 34 in a 30). I think they also said that if the law did try and 'do' you for this you would definitely get off if you appeal, as it's not worth the powers than be persuing it. Apparently it's to allow for innacuracies on speedos, among other things no doubt.
Anyone got any evidence to dispute/rubbish this as I may need to know one day!

This is not true, 31mph in a 30 is an offence so there is no legal basis for "getting off" with 33mph for example.
In some areas they allow you 10% +2mph as this is an ACPO guideline but in other areas they don't. I have seen an NIP for 32mph.

Speedos cannot by law under read, they can over read by up to 10% IIRC. So claiming your speedo read 30 and when you're done at 35mph will just get you in to more trouble.
Again, IIRC, the guideline, which is what you're referring to was in part to avoid some of the quibbling about borderline cases, but as hedgehog says, even 1mph over and you can be done for it.

I know one person who was prosecuted for doing 34 in a 30. And know another who's just received a NIP for 34 in a 30.

When I got my road angel on my ACTUAL speed by GPS is normally 3 - 4 mph slower than my car speedo so when i thought i was doing 30mph was actually doing 26mph so there must be some leniency!!

I got done for 34 in a 30 last year.Tried to contest it,by saying i had bigger wheels on,ratio making the speedo slower blah blah blah...3 points and £60 later..
Remember fairness aint an issue with them,they just want your cash and to get you a 1/4 of the way to your next ban.

I've been done for doing 34 in a 30, I was even still on the brakes as I was coming from a NSL road entering a village, that was about 10 years ago though.
Talking to Police recently who set up money boxes outside my worked, he said he'd only ticket you if you were doing over 35, so I think it depends on the cop holding the gun.

The last time I was done (almost 6 years ago now) was for 34 in a 30 (on Marton Road for those who live in the Middlesbrough area). It was a laser gun in an unmarked van at the side of the road, not a speed camera.
To say I was annoyed would be an understatement...

ACPO guidance to all forces is that you should not be done for less than 10%+2 over the limit to allow for errors in speedos and police equipment.
Does not mean that an individual force wont do you for anything over the limit though. It is not part of the Road Traffic Act.

Speed guns are highly inaccurate,never just pay the fine ,fight it all the way,check out www.pepipoo.com for excellent advice.This site saved me 3 points and £60 for a 81 mph on a 70 speed limit dual carriageway!

take it to court and ask would they rather you were looking at the road or glued to your speedo to make sure you didnt creep a couple of mph over the limit...
im sure theres a difference between slightly over and taking the p*ss...

In the court nothing exists other than the law and common sense is something rarely found in a court so you should under no circumstances go in there looking for it.

I work in Preston and there seems to be loads of those van thingies with their little speed traps out the back window so you do get used to staying within the law! (Last year there was a photo on front page of local rag of one of those vans parked on the pavement whilst generating income - whilst a young mother with toddler in a pram was forced to walk around it in the road (main artery into Preston) at rush hour

Great article in MCN the other week showing some "internal memo's" from some scamera groups stating that they are lowering their trigger limits in all their mobile equipment and camera's because they are falling behind their 2005 figures!

thats what I thought Olly... and once somebody had bought them there is no reason that they wouldn't get shared everywhere & become pubic very quickly if they worked Very tempting concept though esp if you've just received an NIP... (which I haven't by the way - although might be speaking too soon... trip to NBO was only last Sun )
