Driving on the hard shoulder. Good or Bad?

I've been following the trials of various schemes on and off for a while now. At the moment most schemes seem to be a success. I was also amazed that at present if you drive on the hard shoulder you can be fined £60 with 3 pp (minimum if they dont do you for careless/dangerous of course ), but if you stop to use your mobile phone you are only fined £30 and it's NOT endorsable
I'd have thought stopping was more dangerous, but then that's just me

4. If the police or the driver chooses to take a case to court rather than use a fixed penalty notice, the maximum fine is £1,000 (£2,500 for drivers of vans, lorries, buses and coaches). Stopping on the hard shoulder without good reason is a £30 non-endorseable fine. If you are caught driving on the hard shoulder, this is a £60 endorseable fine (with three penalty points).

I disagree. I expect occasionally to see stationary vehicles on the hard shoulder. Other than emergency vehicles I do not expect to see vehicles driving on the hard shoulder. Therefore the penalties seem appropriate.
<pedant>To stop on the hard shoulder, you must at some point have driven on it, therefore could get done for the more serious offence anyway </pedant>
I have not been on the M42 when the permission to drive on the hard shoulder ends, but does everybody suddenly dive out onto lane 1? I would have thought that was a recipe for accidents.
