Had a Crash Today - 3rd Party Insurance Question
Some daft bint decided to turn right out of a 'left turn only' junction today and I had no where to go other than into her car T-Bone style.
As it was not my fault and my car is insured TPFT any ideas what the insurance company will do? My car is a write off but I heard they may pay me out but leave me with the car? Is this right?

if it wasn't your fault, then you won't be claiming on your own insurance. You will be claiming on HER insurance, and therefore will be sorted out no probs, regardless of you being only TPFT.
Or am i missing something?

Although the method of claiming on her insurance may be open to debate.
For people who are fully comp, you ring up YOUR insurance company and get them to sort it. Either they pay you money from their pocket or claim on HER insurance.
For TPFT I am not sure your insurance company will do that for you. You may have to contact her insurance company and go through the claim process.

If you claim on your own insurance they will kindly write back and state that you are not covered. You will need to claim from her insurer and then prove it was her fault. This is where the tricky bit comes in....

Your own policy may include the provision for an "Uninsured Loss Recovery Service", meaning that your insurer instructs a separate firm to pursue your losses on your behalf. If not, then your best option would be to look under the yellow pages for those solicitors that perform the same task - they take their fee directly off the negligent driver's insurance.
As far as the salvage (ie your bashed car) is concerned, it's likely the third party insurers will allow you to retain this, but note they will make a deduction from their settlement based on the salvage value.

More insurance comps. seem to take care of the innocent party (even if you are fully comp) as the are in control of all costs i.e. repairs and loan vehicles.
I just don't fancy having a salvage cost deducted off the settlement by the 3rd party and being lemoned with the car as well.
Will report it in the morning to my insurer WFIW and try and get her insurance details (seemed the wrong time to ask as she was being put in the ambulance)

same thing happened to me i had the choice of keeping my car or selling it to them but it was only £150 less to keep it than to give it them so i gave it to them it was no use to me, did you get any injuries??? did she admit liability??

go to your local walk in centre tomorrow get checked over properly say you have buzzing/ringing noise in your ears all the time you notice it within a few hours of it happening and bob is your uncle!!!

sleepless nights, nerves gone to pot, toe nails falling out, pissing bile, teeth going purple, hair turning grey, belly swelling to the size of a small washing machine and finding that you've wet the bed 6 times in an hour.

i don't think the majority would enjoy it, but if you have a tiny knock and they claim fraudulently resulting in your premium going up dramatically, then should you be crashed into half decently, you'd be in the minority not to want to make your money back...

Before you mentioned your injuries other posters had implied that you should invent some. I believe the response was aimed at those people.

i wasn't implying that at all! I was merely reminding him to make certain he had notified them of any injuries sustained! To write off an impreza, is almost certainly going to result in some injury! The manner to which i got my point across may have looked like i was implying the making up of injuries, but i would not condone that in any way!
