MRSA
As some of you know my mum is in hospital, in intensive care for the last 4 weeks.......I went to see her today and have now been told she has MRSA but it is on her TONGUE....the doctors have never heard of this and have given her the antibiotics needed...so all should be well (fingers crossed)
What I want to know is.....can I now sue the hospital involved as she certainly didn`t have it when she was admitted back in January...I know this for a fact because when I was given the all-clear from my nurses that my wound had healed I asked my mums hospital to swab her to make sure she was safe to visit for both her and me...that test was negative....but bet your bottom dollar they have conveniently lost that result when I ask for it now......
Any advice would be really appreciated...
Joan.

Im not up on the legal side of things but i work in a hospital and to be honest i really dont think u have any grounds on which to sue on. Im maybe wrong about it, maybe u can sue. MRSA can be carried by anyone or anything. Someone visitin her could be responsible for passing it on to her. so i really cant see the hospital sitting and taking the rack for it when it could have been contracted anywhere and from anyone.

As Im sure that you are aware, many people carry the MRSA bacteria in their nose. Considering this it would be extremely difficult to sue the hospital for an infection on your tongue, unless you have had surgery or perhaps injections in the area in question. It may be possible that the infection was contracted through contact with medical equipment used in the ICU of course; perhaps a firm of Solicitors who specialise in medical negligance cases could guide you? Irwin Mitchell come to mind.

From previous experience the NHS are almost untouchable when it comes to proving negligence and trying to sue even when you have very good grounds.
I can't comment on how strong your case is but one thing you have to consider is that it would more than likely cost a lot of money in legal fees taking on the NHS as it would take a long time and this is at the risk of not winning.
I hope your Mum recovers quickly.

Im not having a go here, but why ios everyone in such a hurry to sue someone?
I personally dont see how you can sue a hospital because your mother has contracted an infection that could have come from anywhere.
Im not even all that old, but I remember the Good Ol` Days when people had accidents, people got ill and people were injured and no-one got sued.
I find it a bit sickening that the NHS has to divert more and more money away from patient care to pay off law suits.
I blame the Americans.
All imo and I hope your mum gets better.

Im persoanlly aware of a case where a baby was starved of oxygen; the result was severe brain damage. The NHS destroyed the relevant 12hrs of printed records; simply cut the printouts. This was blatant, they were fined £250,000 for this act, which was a result considering that they were liable to pay over ten times this amount in damages.

Agree with David.
MRSA can be carried by anyone, hell it could even have been passed on to the lady in hospital by a visiting family member. It's a shame when the instinct to sue comes before even researching basic knowledge of the problem in question.

David Dickson...I'm not in a hurry to sue, but my mum has been in this hospital since 17th January....moved to Intensive Care after an incident on one of the wards....which was also the Consultants fault......she is now in isolation in Intensive Care for the last four weeks.....it has been one thing after another in this hospital and to be honest I am getting really fed up with what sounds to me as excuses...sometimes I wish I knew more about the NHS and medical matters because I feel if I knew more I could argue my case more......

I have asked to see the Chief Executive of that hospital...but they don`t see anyone apparently....so don`t know how to get through that one...have spoken to the consultant who admitted over the phone that he was sorry and didn`t realise that my mum was that ill, he gave her a 10% chance of survival....can`t tell you how much of a shock that was!!!!
Anyway, she has managed to get through four weeks so hopefully things are looking on th eup...except for this latest episode!!!!

My mother in law has just come out of hospital after being admitted for a triple by-pass in January. During her time there she caught an infection in the op wound, got MRSA, had renal failure due to the staff not monitoring her fluid input/output properly.
She was supposed to be in hospital for 10 days but eventually spent 11 weeks there, and this is Harefield Hospital which is supposed to be a good one.
If everyone sued who got an infection or incompetant care the NHS would collapse. What little money the pathetic Labour government give them should go on health care, not compensating for MRSA.
My neighbour is a microbiologist and sees about 200 MRSA cases a week passing through the labs. It isn't a big deal unless the infected person has a very weak immune system.
