Ive had problems with faulty good before. just a thought but how did you pay? if you paid by paypal if they guy isnt very helpful through emails then file a claim through their dispute section. then its all logged.
Whats the blokes feedback?
is there anywhere in the auction that states no returns?
Most sellers are ok if the items are faulty.
good luck

I had a problem with a buyer who bought a VHS video from me. 2-3 weeks later she emailed me to say it didn't work. I said I test all of the tapes before sending them out and it must be something wrong with her player. She said she had tried on two of her players and it had not worked, which got me suspicious.

She wanted me to refund her all the money she paid including postage and keep the vid. I said no, send it back to me at your cost and I'll see if it is indeed faulty. She sent it back, it worked fine. Didn't refund her a penny, asked if she wanted back via email - at her postage cost. Never heard from her again.

I guess she wasn't bothered, as she had probably copied it anyway with her 2 VCRs.....

lol
I was selling white label promos/bootlegs of call on me (not the eric prydz mix- but the one before that)
I had 25 copies @ 30 squid each and i sold my last one to a lad up in manchester...
2.5 weeks AFTER i had sent it, i get an email saying he had been on holiday, and had only just returned and played it at his club.
He said he couldnt mix with it, as he couldnt hear the bass, and it kept skipping- and wanted to return it for a full refund (including postage he had paid for)
Coincidentally, this was just a few days before the official single release of the track which would then cost him 3.99 in hmv. Didnt take a genuis to work out what was going on.

I refused his claim about not being able to mix with it- as i had been playing the same record out for months with no problems, and the fact that it WAS a bootleg remix was the whole reason for part of the sound. Both were stated in the auction, so i told him to buy some better headphones or learn how to mix.
Regarding the skippage:
I told him to send it back to me, and i would test it on each and every technics turntable at each venue i work at (added it up to be something like 27 turntables counting each different room) to see if it was skipping. If i found it to be a valid reason for return i would refund him. The facti had checked each copy before posting was also mentioned.

Never heard from him again!
Im normally helpful, but this guy was just trying it on blatantly

Most sellers are fine with a genuine reason- log it with paypal if he is not helpful, and that should help. Is it a genuine disc? Or have you been sold a copy?

Could it be a non-UK version of the game? (i.e came from the US), may need your x-box chipped to get it to run. If that's the case, and it was a UK based auction then you should be entitled to refund under goods description.
