Tv prog. tonight about people who used extreme force to protect property (thinking scoobs/house here..) and how the law dealt with them!!,may be especially interesting to anyone living in large citys ITV 8pm ("tonight with Trevor McDonut" )

Just don't forget how ****ed Tony Martin was for his 'un-justified' use of extreme force! If there were more people like him then there would be a lot less crime!

Didn't see it but I saw the report on BBC news from the US. They all have guns in their houses and all said they would shoot anyone on their property. As a result innocent people have been shot but they all say it's worth it for the added disipline it brings society. You won't find any scum like Fearon there.

They can't believe the way Martin has been treated.

The USA may have 50% less burglary per capita than here but they shoot each other like rabbits!


Then again a total nutcase like Martin would be legally allowed to own his pump action shotgun in America.

The more I hear specifically about Tony Martin's history the less sympathy I have for his jail sentence.

OK, they have their 'trailor trash' too, but they don't go around robbing the suburbs at will like in this country. They have to rob each other. Communities are far more segregated<sp> in the States partly because of scale, but partly also because of 'american values' that allow the defence of property by force.

but maybe I have it all wrong.... any yanks out there care to put me straight?

Bottom line : Someone was in his house who shouldn't have been. I'm afraid I'd use a gun to protect myself if I lived that far away from civilisation and the bill hadn't responded to previous call outs.
People SHOULD NOT break into other people's houses. Its wrong and against the law.

people will say this that and the other. i care not. it comes down to this...

those theiving *******s decided to willingly break the law when they entered his property therefore in my eyes they left their rights behind and deserved what came their way. you CANNOT break the law and yet at the same time expect it to help you, it's one or the other.

well done to martin, pity he didn't kill both of them, society is not at danger from martin, but from the menace of theiving *******s like those 2.

Problem is we're all confusing justice with law.

Justice says that Martin was within his rights to defend his property against repeated burglary and intrusion.

The law says he discharged an unlicensed and illegally-held firearm, killing one person and wounding another. The law takes no account of where it happened, or why.

My auntie in America often leaves her front door unlocked and leaves her keys in her car (so she doesn't lose them).

Violence and crime is far more "ghettoised" in the USA than here.

Bug Eyes. How do you feel about Fearon's record then? Does that evoke your sympathy for him? He is using the situation to attempt to make money out of his law breaking behaviour. What do you think of the character he is displaying?

How would you feel if you were living alone out in the sticks, having been burgled 30 times and found that the police will not even come out when you call them. How would you react to having your house broken into in the middle of the night with no knowledge whether you are about to be attacked physically and seriously injured. Are you just going to stand there and let them do what they want to you?

You have no right to call him a "nutter". I wonder if you have the bottle to justify what you said.

I didn't read the case report but didn't the law take into account the fact that he was a rather deranged chap who had threatened to kill those p(non-scoobynet-friendly)y b(again)ds on a number of occasions, and he'd decided to teach them a lesson this time?

You're allowed reasonable force and the law decided, in all the circumstances, this time it was unreasonable?

I could be wrong but I thought there was a lot more to it than the Mirror makes out.

trouble is...... he did shoot him in the back. If tony had been able to shoot him in the chest ....then it would all be different.

I'm happy to be corrected by a lawyer here - but I believe that the way the law stands in this country you are much more likely to 'get away' with using deadly force if the intruder is upstairs as they're considered legally to be more of a threat.

One of the problems with the Tony Martin case is that they were downstairs when he shot them.

(And my source of such wisdom? I've spent a lot of time working inside mens prisons! Not as a prison warder I hasten to add!!)

I wont what work you were doing in prison, and if you were paid in cigarettes.

You are more likely to "get away" with injuring / killing someone in your home if you can prove that there was some threat. And killing them is the best option as there is only one side to the story then. A police friend once told me that if you find someone in your home use whatever force is necessary but try and artificially (if you have to) create some threat. Whether it be a knife from the kitchen or even them holding a heavy object.

If I found someone in my home, I would be completely scared and my actions would probably be completely irrational. I have an airpistol and hopefully wouldn't hesitate to use it. It wont kill, but hurts like hell (don't ask how I know!) and is a stopping force if aimed at the face.

Steve, be prepared to reverse that air pistol and convert it into a club.
It would then be VERY effective when the butt is covered with the miscreats brain matter!!!!!
If you "mearly" poke his eye out with a pellet and don't finish the job you will be liable for a very hefty medical bill.

I can assure you, one and all, that only wounding a burglar will cause you more grief than you will ever want.

Shooting them in the back is definatly a "NO NO!"
I speak from experience as I converted two, to very honest citizens, who will NEVER burglar again.

From what i read Tony Martins 'history' and mental state were not allowed to be brought up in court... could be wrong though as i only read it in a comic..err .. newspaper.
