Buying a car without warranty ?? anger strikes again
We went to see a car the other day and loved it. So we put a deposit down as we wouldn't be able to sort out finance for a day or so.
It was only after we gave the deposit that we found out that the dealer wasnt prepared to give a warranty. ...
Not only that. Printed on the invoice sheet for our deposit that my wife had to sign was "i also understand, that i will be personally liable for any expense incurred by the seller in preparing the vehicle ready for delivery and any other loss incurred by my withrdrawing from the contract"
In addition, we were told that the car wouldnt have an MOT on it, but he could do it before selling....but..we'd be charged for any problems they found.....
AND......we were also told that although we had put a deposit down, if someone walked in with cash between us leaving the garage to sorting finance, then he would accept their money and refund our deposit
Needless to say we pulled out of that deal, but now we are being refused the deposit because we knew it was non-refundable before paying....well have we legal grounds for withdrawing ? or is that our deposit gone

Before paying a deposit you should of signed for what you was getting ie a car with 12 months mot.
As for them selling your'e car that you have put a deposit on that straight away would of rang alarm bells.
Sounds like a **** hole garage and you was at fault putting deposit down before knowing what you was paying for,Its life we all live and learn fela move on and learn ,ps how much deposit did you put on, and what was the value of the vehicle .

Car value was about 5.4k. We only put a small deposit, but its the principle.
The reason they gave for accepting a cash deal and refunding us if someone came in was that they didnt have to put it in their bank.....Which to me means they don't have to pay tax on it.
The only thing we signed was a invoice form.
But i think where im getting at is, although we signed a invoice sheet that said no deposit will be given if the buyer withdraws. whats are the legal rights behind selling a car with no warranty. Though all garages had to do that these days. And if so, i can use as ammunition for returning the deposit

I havent signed anything to say whats included in the sale.. it is literally a invoice the half the size of an A4 piece of paper with Deposit on the top

A few years ago I got my "non refundable" deposit back from a horribly little back street car trader with the aid of a baseball bat and the threat that he would not have a straight car on his lot the following morning if I didn't get my money back right there and then.
All his henchmen gathered around us and it was a case of who lost his nerve first.
Luckily for me, he decided that for £100 (when this was a lot of money to me) it wasn't worth the risk of me coming back later that night. (Which I probably wouldn't have done anyway).
I certainly would not recommend this option now, but it worked for me back then!
Needless to say, I've never put myself in that position again since and have been very careful when buying second hand cars from any trader, including main dealers.

First thing is are they a registered dealer or just a car seller, secondly is your signature only on the "invoice" and there are no t&c on the paper. If they are a dealer they only have to offer 30 days warranty and can present the car pretty much as they want however the 3 month as mentioned is a good will gesture, the deposit side of things is that a deposit left is non refundable unless the deal is subject to finance and the application fails it is at the dealers discretion to refund. If they are just a car seller there are no or very little rules or laws I would try threatening small claims court.

If you put a deposit down to reserve the car but the dealer can sell it to anyone who turns up with the money then surely there is no point in putting down a deposit because it is totally meaningless.
Or am I missing something?

I would say that putting a deposit to secure a car represents a contract, by telling you that they will sell the car to anyone that comes along with cash means they have no intension of honouring it, so are in breach of contract from the off.
Pointless.
