If You Are Car-Jacked
Does the Insurance pay out if you meekly hand over your keys - or do you have to put up some form of fight (so that it is classed as Aggravated Theft)?

Some years ago one of my younger sisters was driving through our local town center late one saturday night when a group of boys tried to make her stop her car (presumably for a lift) she panicked and floored it, knocking one of the lads clean in the air breaking his leg.
She drove straight to the police station to report what she had done and in short got off with it with not so much as a telling off.
The coppers involved were completely sympthatic and said next time the lads might think twice before forcibly trying to stop someone in their car.

AFAIK they will pay out as its classed as aggravated vehicle taking, but I'm sure I read somewhere that some insurers weren't paying out when the keys get 'fished' through your letterbox.

Joking aside: your inurance cmpany will require that you take reasonable steps to safeguard your car. i.e. not leaving it unlocked, keeping your keys in a safe place etc... and not be neglegent i.e. leaving the car running when you're not in it! They may refuse to pay out if you don't adhere to these requirements
They will not and could not every require you to take reasonable steps to protect your keys when they are demanded with menaces.
Aside from being highly dubious from a legal, moral and financial perspective, it would also be almost impossible to enforce!

Someone asks for your keys. 2 second assesment then chin-em. Ask questions later.
If it was harmless fun, they learnt a lesson. If not, you've escaped/caught them.
If giving 'em what for is not an option. Hand over keys, smile, watch them drive off, then come to a stop. Wish a noisy xmas tree on the road. Bless Blackjaxx!! You get them/away, they get a (short) drive in a Subaru. Everyone's a winner!
Honestly though, how can the insurance co. assess what is acceptable? If you were threatened, that should be enough?!?! Just forward them to links like the one of the dude in/around B'ham with the screwdriver. Awful that one.
