GETTING YOUR LICENCE BACK
Ok people, i have a mate who was recently banned for excessive speed.
She had her licence and was still in the probation period of 2 years and got awarded 6 penelty points therfore had her licence revoked under the totting up.
She has got her provisional back and is about to re-apply for her licence by sitting her test again. The strange thing is, the licence has got 6 points still on it. Is this correct?
I was lead to believe that when banned under totting up, the points are removed?
Does anyone know that actual laws to this or have they had any similar experiences themselves

Its a strange one! Someone I know was done for drink driving (twice the silly c**t).. He got a year ban, but his license came back clean?? Other friends have been done for speeding, totted up over 12 points and lost their license, when they got it back it still had points on?
God knows, but to be honest I think drink driving should be punishable by castration but that's another subject.

You got back to square one, so if you get 6 points within the first 2 years you'll loose your license again, the other points are just there to screw you over for insurance.

thats what we are concerned at, because, technically you cant drive with 6 points on, so i know its silly, but looking at it from a simple point of view, she can be banned again.
tried the usal resorces, so far nothing back that says either way.....

I think that the points are still shown, but don't actually count towards her total, a bit like when speeding points expire after three years but still have to be shown for four years - as far as affecting insurance, etc. ... hope not, my first 3 points expire mid March so I'll find out soon enough I guess when I call the insurance co...

Basically if you get 6 points in your first 2 yeras it's the DVLA that revoke your licence and not the courts as they would under normal totting up rules I think.
That's got something to do with it, but I don't know the ins and outs!

How long was she banned for, or did she have her licence revoked?
What was the offence code on her licence?
If it was revoked and given back once she had passed her test again, then the points will probably stay on her licence for 4 years and count for totting up rule for 3 years.

the licence was revoked and she could apply straight after the court ruling.
i cant see the points counting towards totting up, as she is still within the 2 years. as your only alowed 6 in 2 years, if that is true she automaticly gets banned now, so using that school of thought, surely thats not right???

Hey John,
As far as am aware the six points stay (sorry appear) on the licence for four years as they would under normal circumstances. Once she passes her pratical test again she will start off from scratch with other six points allowed for the first two years, then after which if she hasn't had any more convictions she will still have the six points picked up from the first time around for the third year, but these will appear on the licence for another year after that(total four). Basically she has six points to play with for the next 3 years. Hope that makes sense, wish her all the best and tell her to slow down I know how easy it is to get caught its better to arrive 5 mins late than not at all.
If she gets another six points during the next two years she will get the licence revoked again, and as she would then have 12 points on her licence she would face being banned from driving for 12 months at least and try explaining that to the insurance companies, licence revoked twice and banned from driving

What you need to remember is that in totting up cases, a ban is not actually obligatory, it's just that the Magistrate will nearly always choose to ban.
