Killer driver was going three times speed limit

TWO people died instantly when a turbo-charged car travelling at almost three times the 30mph speed limit in a built-up area hit another vehicle, a court heard yesterday.

The driver, David Marshall, 30, who was under the influence of alcohol, survived the Saturday lunchtime collision but his passenger and the driver of the other car died.

As he had emerged from the wreckage, witnesses heard Marshall say: "This is all my fault."

Marshall, a pipe fitter, of Buckhaven, Fife, admits causing the deaths by dangerous driving of David Smart, 39, of East Wemyss, and Ross Bennett, 28, of Methil, both in Fife, on the A955 Methilhaven road in Buckhaven on 10 April last year. He will be sentenced next month, and faces up to 14 years’ imprisonment.

The advocate-depute, Alastair Brown, told the High Court in Edinburgh that Marshall’s Subaru Impreza was capable of 155mph.

Marshall’s car entered the 30mph zone and struck Mr Bennett’s vehicle broadside as it was turning right, across the east-bound carriageway.

"It is clear on all the accounts [of witnesses] that Mr Bennett’s manoeuvre was reasonable and was safe, on the assumption that the east-bound traffic was travelling at a sensible and predictable speed," said Mr Brown.

"We know from the accident investigation, however, that the accused’s speed at the junction in the 30mph limit was approximately 83mph to 85mph."

Mr Brown said Marshall supplied a sample of blood after the accident and it was discovered, by back calculation, that he had been marginally over the legal alcohol level at the time of the crash.

The defence counsel, Edgar Prais, QC, said Marshall, a first offender, was deeply regretful for having caused "this terrible tragedy" and he had been seeing a psychologist. Lord Brodie agreed to continue Marshall’s bail while background reports were prepared for next month’s sentencing hearing.

It's a terrible thing to happen, but how many or us can say we have never had that mad rush of blood to the head which has made us do idiot things behind the wheel ??

85 in a 30 is a bit extreme tho ....

No, but its important to bare in mind that a car is not responsible for those who drive it. We all like performance, and I'm sure most of us have exceeded the speed limit at some point, but you have to use a measure of common sense: doing the best part of 90mph in a 30mph zone is simply not on. At least the chap had the integrity to admit it was his fault. He now has to live with this on his conscience and that's not something I'd wish on anyone.

Very sad!

Lock him up and throw away the Key, I myself was the victim of a driver who did a very simular thing when he hit me at 120mph head on god knows how but I survived, but the pain is their everyday of my life

'The charge carries a maximum penalty of 14 years in prison. ' Sounds like he'll have plenty of time to sit and think about the pain and loss he's caused out there , very sad .

Good grief, 120 head on? Is that closing speed or just what he was doing?

Well where do we beging?
I was driving back from Miton Keynes in my Royal Mail Ford Escort Van (4 months old) First fleet of small vans we had we an air bag fitted.

I was driving along the A421 back to Bedford at about 55 to 65 mph, It had just started to rain and my wipers wern't really doing much so I hit the washes and almost has the water hit the screen he hit me, he was travelling that fast the first thing I knew about it was when he hit me.( He over took 3 cars on a blind bend)

I had my glasses on to drive with(fitted with glass lenses) and the air bag went off and knocked them off my face, luckily for me the glass did not break, and to this day we have never found them, my window was not open so we don't know where they went.

My van spun 360 degrees and I hit a lamp post and with the force of the impact took it out of the ground, I remember the lamp going out and glass hitting the roof of my van, When I came to a stop all I remember saying was I'm gonna rip his ******* head off, and a little was inside my head said your going nowhere sunshine, the van had done it's job split in two and the complete engine and gearbox was about 50 yards away, I was trapped for about 3 hours and was told by a doctor that if I did not come out very soon it could be a bit dodgy for me, one of the things I can laugh at is when the van stopped spinning someone opened the passenger door somehow **** knows how and a guy in a green uniform said don't panic mate I'm a paramedic, and I said **** me mate that was quick he said no I was in the traffic going the other way my right leg was totally smashed my right knee fcuked my hip and my back, at first they thought I had broken my back but thankfully that was not the case both my ankles were bent to **** and trapped under the pedals, I should have died that night and someone was looking after me, when you get a traffic policeman say to you I'm talking to a corspe, thats when it really bought it home, when the police got to the scene of the crash they asked someone what were my chances and they said this is gonna be a fatal but some how I kept fighting and fighting cos their was no way that Ba$tard was gonna kill me, I had a doctor come to me and he said that they had to get me out because my blood pressue was dropping I later found out I was very close to dying then, so when I see headlines like that I get very up tight and angry cos it is so unnescery.

All I know is that the guy had been sacked from his job that very day, and he went into the pub before he drove home to drown his sorrows, The Policeman in charge of my case said he was the sort of guy that did not give a toss about anyone apart from himself, cos the first thing he did when he fell out of his car was get his brief case out and phoned his wife, not the emegency services, his WIFE we later found out he was going to get his wife to take the blame for the accident but the police saw through him, he then walked down the carrigeway and collapsed one cos he was so pissed and 2, he was in shock, He was found guilty of drunk driving, dangerous driving, he got a £ 375 fine £125 in costs and a 15 month driving ban, the copper went mental at the sentance because he really should have gone down for it, 2 really good things came out of it, I bought my house and my Scoob so when I drive my Scoob it makes it just that little bit more special, but I still wanna make him suffer the pain I suffered and are still suffering from.

Feckin el!! Some people, well you just can't find words strong enough to describe them can you? I agree with the copper: the punishment most definately did not fit the crime. Driving is a privalege, not a right, and if you abuse it like that and endanger other peoples lives by -frankly- being a selfish, irresponsible ****, you deserve to have it taken away for a VERY long time, not 15 months. This should also have been a custodial offence

It's lovely that some good came out of that horrid situation! Things don't come much better than a good Scooby either!

I think the guy who died in the scoob(passenger) was the owner of the car and well respected on the scottish forum and well known at Knockhill.beleive he was giving him a shot of the car.
not 100% on that, it just rings a bell somewhere.

Different incident all together, the car involved was a P1 i think. I remember seeing it in the paper.
