I had an accident on thursday night. i had to turn right into a perpendicular road, so I waited the car was coming in the other direction to pass so I coould turn. Unfortunally the car hits the brakes when i'm turning in the above mentioned road , and goes backwards till it touches me of the right back doors provoking a "hole" of 15 centimetres with his bumper.
He admits his fault and we fill in a module Italian Insurance gave me.
I call him on monday giving him details of the estimated price for a new door + fixing on the wheelarches.

He calls me back today stating that his insurance found the estimation too high and is going to use it's own garage.

Is that possible on UK legislation? what if I don't trust them and wants my garage to do it? Should I now something more?
Do you have any advice?

help very much appreciated

You don't have to use their repairer, as long as the one you choose is reasonably competitve with the estimate, then you can dictate where it is repaired.

UK Insurance specifies that you can choose who does your repairs.

Ian - Car currently in Subaru having insurance repair.

what you mean by "as long as it is competitive". Is it interpretable? By whom?

get a repair quote done by at least two other repair garages, compare the prices, if they are similar then it's "competitevly priced".

It seems that counterparty's insurance won't pay because it states that i was wrong not paying attention when I was turning.

what do you reckon?





I waited the other car to continue in its direction, then i turned in the perpendicular road. he then hit the brakes hard and went backwards into my right door.

Shall I be partly responsible?

The guy agreed that is his fault and now seems willing to pay cash the damage he provoked. The insurance will make an appeal if he wants to be covered.

I've got doubts that his insurance could have been expired 2-3 days before. If so, is there automatic re-insurance when it expires?

Please help

How did he manage to go backwards after hitting the brake?

he stopped and inserted the rear gear with a "crack"

he was probably looking for that particualr road and came backwards to check

I think it's normal for the insurance company to try to get away with not paying out. I doubt it could ever be your fault. You were looking ahead, in the direction in which you were travelling. The other guy obviously was not looking in the direction in which he was travelling, otherwise he would have seen you in his path. Given that he hit your rear doors, you must have been turning before he reversed. Don't worry, the insurance company are just trying it on. ignore them.

I've thought about this, and it's not entirely true. Because the rear wheels don't steer, it would be possible to drive round the back of his car such that the front of your car got round but the rear door clipped the corner of his bumper. So I wouldn't rely on the 'he hit the door, so it must be his fault' argument

Your not responsible, he has admitted liability and you can choose whatever garage you like matey!!

Something I learnt the hard way so trust me everything everyone has said is true!!

It's his fault entirely. Insist on going to the garage of YOUR CHOICE. It's a bit of a nightmare and takes a little longer because you have to get a couple of quotes but it's worth it in the long run. Believe me..... I know!!! Goog luck

Be careful leaving it to your insurance company as you may find come renewal time that they decided that it was your fault or that it was "knock for knock". This has happened to friends of mine so make sure you make sure that your insurance company recover the cost from his, or you will have a claim on your history...
