I was going a little bit to fast tonight and was caught doing 93mph on a country road (60 limit).
I have 3 points but did have 12, i kept my licence due to loss of hardship ( it would affect my job) but i believe you can only be allowed this once.
Any info would be helpful as this is my worst nightmare if i loose my license for a long time, also how will this affect my insurance??????

When you say you have 3pts but did have 12 - what do you mean? Have those points run out of time/become "spent"? Are they more than 4 years since date of Conviction? You were defending a "toting" ban on hardship I presume. Are the points that you received at the time you entered a plea of hardship spent? If they are, then you can enter that plea again. If they aren't then you can't (legally). +33 on a limit is definate ban territory, so in any case, don't listen to us lot on the bbs & go see a solicitor.

Insurance? Depends on age/insurer/your NCB/accident record & all the other bits, but expect a rise for a ban on a pure speeding for sure & probably less of a rise for a tot.

same thing happened to me a few years ago,got to 12 points, pleaded my licence for work, got off with a fine,only problem i was left with 12 pionts!a year later got done for 71mph on the A 1 near newcastle(just 200 yards after it changed to a 60 limit) issued with a fixed pen but when i sent my licence off i had to go to court, talked with a brief , he told me not to waste my money as i would get automatic 6 month ban , and advised me to just use the duty soliciter,(which i did and it turned out to be him any way)
things may have changed but if your last court apearance was within the last three years i,m afraid it looks bad,
but one thing you must do is take PTMW's advice and get proper legal advice!!!!!
and dont worry 6 months soon pass's (i know from experience)

If you have spent points (and by that I mean over 4 years and no longer showing on your licence) then it's as if you have 3 points on your licence, nothing more.

As things stand you face a ban for the current offence, which would probably be a 4 week and 6 points job. Your licence would then come back clean (though you'd have to check this out).

As Dave T-S said in a previous post, it's worth speaking to Andreas Serghis about this. Be guided by him rather than us, cos he knows his onions, he really does.

Also check whether you have legal cover on your insurance policy - if so, you'd be daft not to hire a solicitor, cos you'll only have an excess of £100 or so to pay.

Every case is different, but I'd say that with the proper legal representation you may be able to get off with points and a fine. You then have the tricky problem of driving around on 9 or so points for a couple of years.

Sorry to hear that you got caught, but I got caught doing 101 on the M40 during the middle of the day (3 wks after getting my Scoob)

I was given 6 weeks ban and £385 fine... so there is light at the end of the tunnel...

ps. I didn't bother with a brief...if they are going to do you then you will get done..with or without a brief.

Oh I didn't have any points to start with but I had been ban before about 4 years ago doing 115 on the M4 at 3.00 o'clock in the morning.... I got a stright ban for 3mths £490 fine and NO POINTS

Speak to a lawyer - I know a very good specialist if you want.


But - you can only use 'hardship' once FOR TOTTING UP. 30mph over the limit would be a discretionary disqual, so you can use 'hardship' again BUT, you might be on a sticky wicket given driving record!

If it really is a hardship case, you will be ok. Point to show are how OTHERS will lose out if you lose your licence, and get your boss to go to court rather than just write a letter.

You will be looking at 5 or 6 points, anything from 21 to 56 day ban and a fine of £250-600. A good silicitor should be able to plead the case that a ban would be extreme hardship, but that by giving you 6 points would put you on 9 - thus forcably slowing you down to avoid a second, and far more severe totting-up ban!

Good luck and GET A LAWYER, given your circumstances you would be stupid to try without

I remember something like this in a previous thread. I'm well carefull about letting my scoob off the leash.

It's tech war out there, and I'm afraid the police have the advantage.

It is for our own safety which I have to keep reminding myself. It's so easy in the sccob to cruise past the legal speed limit. Like I said in a previous thread. I feel as though i'm driving with a copper in the backseat hiding under a blanket, waiting to pounce as soon as I hit 71mph.

And what do we do..... We modify our cars to make them go faster.... Sheshhhhhh !

Jason - Get proper advice. History would say that you will probably be able to save a few months petrol money towards your renewal premium on this, but a good solicitor may be able to remove some of the pain - good luck

I recommend also Andreas Serghis..I used him and was facing a ban. For 11mph I got 4 points and 375 fine. Give him a call.

if your license is so important to you/your way of life, then driving at over one and a half times the speed limit does seem a little silly, especially as you've been done before, second chance and all that.

My advice (to anyone not just Jason b), if your license is so important, don't speed so much.

Just my 2 penneth worth, flame suit on.

Penalties have changed since then. 14 day ban is no longer an option. Minimum is 21 days, although very few people get less than 28 days AND get 5 or 6 points Fine will be 300ukp + unless you are a minimum wage lurker!

All down to the luck of the draw on the day. Just practise your best sheepish look and get your solicitor to do all the talking. Despite what others might say, you do have an excellent chance of avoiding a ban if you use the good lawyer.

But the best piece of advice is to slow down if losing your licence is such a nightmare!
