I was involved in an accident on Friday & I need some help !
i was driving down the right hand lane of a dual carriageway & came to a set of lights which were green
A woman was coming the otherway & turned right accross my carriageway & ended up pushing my car into a temporary traffic light with a concrete filled barrell round it.
I ended up in hospital therefore
She says she went through on a green filter which is impossible
as there are green lights in both directions then the lights in my direction go red & a filter green will show up in her direction
obviously you can turn right across road on green if there is no oncoming traffic

Are there any accident investigators on here ????
or some one who can help my with advice on what i can do to prove it ?
ie work out speeds & timings etc etc ?

Cheers
Paul

From what I understand there is data logging on the lights so they can check if she is telling the truth.

A friend had a very similar accident to yours, he was also in the right hand lane of dual carriageway.. he hit the car side on as it turned across in front of him, sadly the passenger in the other car died pretty much on impact. A subsquent investigation found that both drivers had a green light ( other car a filter to turn right ) at the same time. No one was prosecuted and both cars were a write off.

Edited for spelling.
Not sure how you could get the data checked, in my friends' case it was obviously a police matter because of the fatality.

Ouch. Glad that there were no serious injuries / fatalities. Did you get any reg numbers of any one around you for a witness? Were there any traffic cameras on this particular section of the road? The council / Highways Agency (?) may be able to tell you the sequence and timing of the lights.

In Swindon there is a new road which is dual carriageway (for those who know Swindon its the new northern link road from Sparcells up to the Turnpike roundabout on the 419)

On each junction they have put traffic lights in, one junction in particular is a major junction (Lady Lane). For some reason when the main road is Red, the crossing route has Green lights to both straight ahead lanes, and Green filters on both right turns. The number of accidents at this junction is horrendous.

It's not too bad for us residents cos' we know that that both sides have Green, I suspect that most accidents have someone new to the area involved, and I really sympathise.

Anyway, just to let you know, the situation you describe is not unique, and this is a brand new junction!!!

Nasty, hope yer ok.

My mother and wife were involved in a similar accident about 8-10 years ago in Guildford.
They were going straight on a green light on a duial carriageway, young girl in her mums new golf had a greenlight as well and presumed that meant she could could turn right across the traffic (or the filter light was lit as well, i cant remember now).

She turned across the front of 60mph of Shogun which nearly split her golf in two pieces.

The attending policeman said the lights were at fault and they were promptly covered in bin bags.
My mother took the council to court (advised by her brief) with the policeman as a witness as he had said the lights were faulty (as did the other party).

The policeman retracted his statement (he was advised by a senior officer to do do in the interests of his career we later found out) and my mother was left with the option to take the girl to court, but seeing as the girl had spent about three months in hospital my mother decided not to.

I would suggest you do or get someone to do the following :-

Get the traffic lights on video camera so you can use that to show what pattern the lights are using as soon after the accident as poss.(in case they are chabged)
Get statements from witnesses and everyone ASAP, do not rely on post and court dates, get them asap before they decide not to make one.

Did she hit you in the side at the front. If so then she must of seen you but still attempted to cross the junction. Doesn't the highway code state that you most still check it is clear ?

What speed was the road and how fast ws you going. If it is a 60 and you were going 60 she must of been able to see you and your speed but still pulled into the road ?

Hope the car is not too bad. But the main thing is that you and her are ok

Dave
