PHONES 4 YOU
Sent phone back to phones 4 you for repair. When I took it into store I was asked if there was anything private on it. I told them there was nothing private, just some music and some family photos. Was told to leave it with them and it would be repaired free of charge (still under guarentee) Picked it up today and it was minus its sim card and memory card. Rang the repair company and was told these cards had been destroyed because of data protection. It was only the battery that was faulty so why would they need to remove these. Music, I am not bothered about, but family photos is another matter. Not happy.

Complain and say that you were not made aware that they would destroy your data, and that you were not told that you had to keep your sim and memory cards.
Phones4u are a bunch of crooks. I do not know why anybody would go there.
And more importantly, if they were pics that held sentimental value, back them up!

If they were that important, why weren't they backed up? What happens if you lose your phone? You would still be stuffed.
Yes, Phones 4 u should have known that the sim/memory card would have been destroyed, but you should have backed up your own data. Sorry fella, but in this digital age, I try and back up everything, just in case.

Nobody will say to you from ANY shop your data will be safe as they are protecting themselves and also I'm guessing it has repercussions on DPA etc.
As above - you should've backed up and/or knowing that it was a battery fault, left the memory card with you. I'm surprised they had it with the phone as normally they say keep everything and just send the phone and battery?

We weren't. I returned a dead phone back to a O2 shop for repair under gaurantee. It was returned the in condition "as they sold it" In other words in its original box, with the charger battery, paper work and microSD card (as it was inlcuded with the phone).
After a week, it was declared unrepairable, so replaced with a new identical phone, just had to go and collect it.
Problem is, I got home and found the new one came with no SD card! Phoned, complained, and they gave us a new SD card.
I think the crux here is if the phone was supplied with a SD card in the box when new, then you may have a chance, but if its your own SD card that was supplied separately, then tough *******. Either way I doubt the old card wil be returned; the best they can do is replace it with a new one of same capacity.
PS I did keep the SIM...as that wasn't suppled with the phone.
After a week, it was declared unrepairable, so replaced with a new identical phone, just had to go and collect it.
Problem is, I got home and found the new one came with no SD card! Phoned, complained, and they gave us a new SD card.

If they have permanently deprived you of something of which you had legal title then that is theft.....
The data protection thing is also a smokescreen. Take a computer in for repair and do they trash the hard drive? err no, they repair the PC. If they spot something illegal they are duty bound to report it as in Gary Glitter.
Someone has dropped a bollock. Ask for replacement SIM and card. You will be hard pressed to get compensation for any lost pics though.
