eBay: Buyer wants a refund after 45 days. Advice
I sold a brand new set of headphones before Christmas, and only this afternoon the buyer has contacted me to say they have now become faulty and wants a refund.
It's been more than a month now, so what should I do?
I have 100% feedback so wouldn't want to get any bad feedback or disputes against me but at the same time don't see why I should refund on an item a month and a half down the line.
Hate that there is no seller protection on eBay.
Any advice appreciated.

If you aren't a "Trader" and were dealing with him on a user to user basis - then I'd say he's got no comeback.
If you are "trader" then the goods have to be of merchantable quality.

Has he already left you feed back?
You had no control over the head phones since you sent them out have you?
Surely he can contact the manufacturer.
How much were they?

If he left you positive feedback at the time then I would have thought that after this amount of time he has no comeback. As they were brand new then he should contact the manufacturer who is after all responsible for a guarantee for a year from new.

How do you know he hasn't damaged them in that time? I would politely remind him of how long he has had the item i.e. over a month and that you have no obligation to refund him. Had it been in the first couple of weeks then of course but not after this amount of time has passed. Unless you offered a guarantee there is no come back to you, he would need to go to the manufacturer and probably knows this but is trying it on as he bought them through ebay.

this happened to me sold a phone which was in 100% working order,buyer left me good feedback and after 5 weeks decided that the memory card wouldn`t work ,so ebay sided with them saying that i had too refund them , so always put in my ad`s now that no refund is available ,just can`t trust some people .

Tell him to get real and go and try the manufacturer.
I sold my sons broken Ipod Touch as he asked me to, it went for 24 quid, it was still working as the screen came on but was dim, common fault I read but we got him a new one, sold it and matey boy who bought it came back complaining that it wouldnt work and it had a different fault than the one mentioned and I must have known, I gave him both barrels and told him not to bid on faulty items and then complain when they dont work and that I was not lying and that I dont sit here scheming to make 24 quid by lulling some unsuspecting purchaser of a clearly marked faulty Ipod into buying a faulty Ipod, Ebay seems to attract dicks !

don`t know they put a freeze on my paypal account until i had transfered some money in to refund the buyer,ebay said because the memory card wasn`t working it was then not fully working has it was stated in my ad , best thing about it was when i got the phone back all had to do was reformat the memory card and was working fine.

Buyers on e bay expect the world these days, some people even behave like you are personally responsible for hand delivering their item. Heaven forbid it's not there when they expect it to be.

FFS, I will post it when you pay and the royal frigging mail will hopefully get it to you in a reasonable amount of time, but once it's been posted, it's out of my hands!

I just sold a game, went for nothing, two weeks later the buyer pays for it, I didnt prompt him, just though if he does, he does, otherwise not arsed, so payment turns up and now he is asking when it will arrive after two weeks without contacting me, some people's lives just arent complete without a sh1tty old Gameboy game !

It's been 47 days since I sent the headphones to him.
They were brand new and sealed at the time.
He left +ve feedback a fortnight after he'd won the item, which stated that it was "Great product, and have gotten alot of use out of it so far".
But now he's saying it's developed a fault and wants a replacement.
Unfortunately I'm not a trader and that was a one off item and I don't have any more for sale.
So what should I reply?
I'm an honest person, and had he got back to me within a couple of weeks I would have gladly refunded him.
But at more than a month of "alot of usage", I'm not sure if he might have damaged them himself and now is trying it on.

Hes already left positive feedback so you can rule out the fact he may leave you negative. I would just tell him politely that the item was new and to take the case to the manufacturer as from his feedback it is obvious the item worked when he received it so its out of your hands now.

Just tell it was sold as new, and he bought it in full working order abd that you cannot take personal responsibity for items that do not belong to you.
He needs to contact the manufacturor and see if they are under guarentee.
He has a damn cheek to be honest, but a polite reply will probably be the best thing to do.

Unfortunatly for the buyer he is knocking on an door which is firmly closed. He hasnt got a toe to stand on never mind a leg. Politely advise him you implied no warranty on the listing therfore after a period over 7 days you cant offer a refund for faulty goods. You obviously sold them as new and the fact he left good feedback shows they were 100% workign when he recieved them. End of your responsability

If you were a trader then it would be different.
Tell him that surely he must understand that he has now got to take it up with the manufacturer. Do you still have the receipt or was there a guarentee card in with the headphones?

chancer -- tell him to fvck off at the first opportunity, as entering into any sort of dialogue will make him think you are going to make all the bad things in his life go away, which is cruel. -- he will thank you for it in the end
