Can I withhold sick pay (ssp)?
A member of my staff went sick with work related stress due to falling out with some of her collegues. Two months later (still of sick) she handed in her notice with sick lines to cover her to her leaving date.
previously she was having family problems So I let her take most of her holidays for the year and she also borrowed money from me. I know I will not see the money I lent her but can I take her SSP that she was due for the last four weeks. This would be to cover holidays that I let her take although she was not due them yet?
It's always the ones you bend over to help the most who try and shaft you.

I know the company I used to work for would make adjustments to cover any losses, be it stock, too much holiday, uniforms etc.
They would just put a deductions line on the pay slip. I don't think anyone ever complained.

Most hoildays are done on a pro rata way, ie you earn holiday as you work with firms giving holidays early though they may not have been earnt as such. If the employee doesnt not work enough to earn this and leaves early then yes I am certain you can take this money back off them. Are you paying them full sick pay as you do not need to do this either.

No deductions should be taken from a statutory payment (SSP, SMP, SAP, etx), all you can do is work out how much you are owed and write to them and hope they are honest enough to give you the money back.

Thanks Kev, I will pay her then do as you say and write to her. I have a feeling I have not heard the last of her and am expecting as she is saying its work related stress she will try and get some money out of me some way.
