Question Paternity Entiltlement

Does any one know how this works? Hubbys employers are new to this and have told him he can have the 2 weeks but must use his holiday entitlement to cover these days off, Do we need to apply to anyone or fill in any forms or does this mean he does have to use his holiday entitlement??

id be interested in this as well as will apply to me next year. From what I have been told today with a quick discussion is that you only get paid a certain amount say £100 for example (similar kind of idea I think to ssp) he wont need to use holidays for this, however for full wage then better taking as holidays!

your rights: Who is entitled to paternity leave? - from workSMART.org.uk

No, he doesnt have to use his annual leave. But, if he doesn't then the company does not have to give him full pay for those two weeks - It can be the statutory minimum, which, last time I looked was about £100.

I seem to remember the figure being around £112.75 per week.

Perhaps he could negotiate some sort of deal where they give him one week off on full pay and he'll take the 2nd week from his holiday entitlement? Thats what I'm doing.

Sounds like a good way as £112 p/w doesnt even cover my food shopping bill Think he may be better off printing off the information from the Worksmart website and seeing what his employers say??

Thanks for your help so far guys..

Im in this situation at the moment, baby due in 4wks.

If you have been in employment with the same company for 6 mths before the 15th week the baby is due you are entitled to paid maternity.

Unfortunately for me, i started my current job middle of April and the 15th week before the baby is born is early sept. Missed out by about 5 wks.

However i had a whinge to the boss and he is allowing me to work an extra 37.5hrs in overtime to cover 1 week paid holiday off. Along with the 3 weeks paid holiday im taking, im getting a good month off over xmas and new year Im actually only doing about 1/2 that 37.5hrs in overtime

But if he's been there longer than 8-9mths, then yes he will be entitled to paid time off without having to touch his holiday entitlement.

I assumed the 2 weeks were full paid and anytime thereafter were paid at SSP £112.50?

He'd be better off staying at work. When ours was born I was excited and looking forward to time off with the new arrival etc.

Soon realised it's a fairly dull ****ing crying machine which, combined with irritating relatives circling like vultures, made work a much more appealing option

my current employers gave me one week on full pay and i had the ability to take a second week as holiday. i chose not to take the second week as i work a short drive from home. my colleague (one week later) did take a week at full pay and a weeks holiday thought and it worked well for him.

depends on how approachable your employer is as to whether or not you just end up with the minimum...

I am hopefully taking 2 weeks paternity leave at the crummy 112 quid a week, plus I am 'buying' a weeks holiday pay, so I will get full pay for one week, plus 224 quid for the 'paternity' week

I will also have the option of coming in to work on the odd day and be paid in full for that day if I need to make up any more money

I did some weekend work just gone to cover the shortfall in money too, as I will be off on Paternity Leave at the latest the end of November

Not unless your contract with your employer states this. Your employer is only legally required to pay you SPP rate of £112.50 per week.
