Legal advice
Can any one give me any advice on over hanging branches. I have a tree which was over hanging the fence by about eight inches so my neighbor has lopped them off six inches to a foot back over the boundary so now I have a tree that has a natural shape on one side and a straight plumb on the other. My question is can he legally do this?

If i remember correctly, yes, he can cut back what is over his boundry AND put them in your garden for you to clear up. But i would look into it further if i was you. I stand sure to be corrected though

The way your post is written is a bit confusing, has said neighbour lopped them back over your boundary onto your side, in which case he as commited criminal damage. Or has he cut them back, but only on his side, in which case the above comment is correct, he has done nothing wrong.
The only thing that could effect the outcome in that case is if the damage to the tree is enough that it will effect its health, or stability, then you can go after him for the treatment costs.

It all comes down to whether you want to fall out with your neighbour over 6 inches of tree. It will cost you a small fortune to do anything legally and create a complete ball ache for you if you ever want to sell your house.
Have you tired just having a friendly word....?

yes he is allowed to do it if it is on his property, we have had trouble with a neighbour over the back of our house she has a huge 21 foot conifer it must be atleast 8 foot wide and its blocking the light coming into our kitchen so we asked if we could cut some of it off and she had a problem with it but the council said we could so we lopped about 6 foot off and round the side about 2 foot not a problem since really but if its on our property we have every right to cut it.

i had a problem with my neighbour over 6 inches . he was very upset .. his wife didnt mind , although it nearly caused them to split up .
best advice is to move house where you have no close by neighbours .
ps . **** your neighbours wife just before you go just to **** him off .
