basic legal advise plz
hello all, I put a deposit on a peugeot 306 which looked at on flebay, I have just had a AA check done, and there is lots of problems with it, aswell as its unsafe, the AA engineer would not test drive it as the tyres were showing the cord, anyway Im not prepared to spend the amount of money and time to fix the car,
Ive asked for a refund of my deosit, where do i stand if he refuses to refund it,

Deposits are non refundable in most cases.

A deposit is a "commit to buy", you are now backing out (all be it because of the condition of the car) so he's entitled to keep the deposit in my book.
EDIT as you answered that one above....
OK, what else is wrong with it apart from needing 4 tyres...

If the car was misdescribed and / or is unroadworthy then how can there be a binding contract? Of course the vendor has to return your deposit.

No point in a deposit if you can ask for it back when you feel like, that said though IF your telling us the truth and its subject to the AA inspection then yes you can ask for it back and probably win in a small claims court, again that said, did you put down a deposit sizeable to bother with all that? Sounds like its one to sort out on the side...
