Agency work pay query!!?

Default Agency work pay query!!?

My missus works for an agency and has recently been told that because of a new law that came into force in 2005 she cannot legally be paid until the company she works for pays her agency. They are saying most pay in 30 days but as it stands now we are owed money from work done in October. Further to that they are paid on a friday weekly so any money paid by companies she has worked for on a friday is not forwarded for a full week, i'm assuming the agency are earning interest on this?

What is the law on this, should she not be paid whether the agency is paid or not? Should she not receive it as soon as it is received?

This is beginning to cause us problems as budgeting is near immpossible as we never know what is coming in when!!?

I'm no expert in the law here but this sounds rather scammy.
She presumably has a contract of employment with the agency?
If so what does that say about payment?
Put simply she works x hours for the agency, she should be paid for x hours by the agency every week or month.
What if all employers adopted this approach?
It could be that this agency has cashflow problems so take care because they could cease trading with your wife losing out on money due.
Probably someone who knows the law will be along.
Friends who have worked for agencies on HGVs have always been paid weekly for hours worked.

Sounds very dodge to me.

Just asked they guys I work with, and they get paid whether or not the agency's invoice has been paid by the client.

Sounds like the agency has money troubles.

Do you mean she works for an employment agency ie a a temp covering for maternity leave for example.If so IMO thats a load of tosh.The agency should have terms and conditions and they should say when she gets paid (weekly usually).When the agency gets paid is irrelevant.

I deal with agencies all the time,i'm 90% sure thats true.

(Just to add,agencies go out of business on a regular basis,re Simons last comment.)

I think it sounds like crap too, because if you walk past these agencies a lot of them have signs saying "Work today, get paid today" Your not telling me the company pays them the second the worker clocks off for that day!

Sorry, should have been clearer, the missus is a dancer working in nightclubs. Been doing it for years and always got paid the week after or fortnight after, suddenly this 'law' comes in annd it all changes!?

Just had a look at government website and the 2004 law says payment HAS to be made 2 days after the money is received by the agency or else!

Basically the agency seems to be making money off her (they take a cut) and making money on the interest from holding her money a while!

It's the really late money owed thats bothering me at the minute, its quite a bit!

You need to find a new agency and get a solicitor on to this lot, sounds mighty suspicious to me

The law is there to stop delays in payment. This company are clearly a bunch of pisstakers demand money or take them to court

sounds alot to me me like they may go under soon and want to keep as much cash as possible.

As for the photo's, that would kind of give away who my missus is and might cause problems, perhaps after this is resolved!!!

There must be some sort of association of agencies, not that the one you're concerned with would be a member, but they may have a site detailing the relevant law. Try googling.
