Recording phone calls
Following on from my 'selling an organ' thread is it necessary to tell the other party that you are recording the telephone conversation given that they have their own warning that 'all calls will be recorded'?
If not then I think I have a great wheeze in mind that could become a prank phone call classic and allow me to have some revenge to boot!

I know you have to warn others if your a company. Not sure how you get on with personal calls but I guess something could be done to stop it, invasion of privicy and or human rights, think that one covers everything anyonoe would wanna moan about

It's a company I want to phone and they warn all their calls are recorded, do I need to make the same warning if I intend to let third parties listen to them is the question.

No I just want to make a laughing stock of them in front of all their peers. By that I mean in a way that could potentially damage them commercially. Say by the details of them telling me to go get an organ donation being leaked to the local gutter press......

If you are recording the conversation then yes you do need to advise them.
(also...just because a company tell you calls are recorded don't rely on that if you need to use the tape in court, a lot of companies don't record their calls despite what they advise)

You do not have to tell a person that their conversation with you is being recorded; but a lot of nonsense is talked about the subject. The law is quite clear: only one party to a conversation needs to be aware that it is being recorded. The point here being, of course, that a conversation can not be recorded where neither party is aware that that us the case.

I agree with GC8 - only one of the participants needs know that the converstion is being recorded. The law changed a few years ago to allow this (previously both/all parties must know)
