Default Law Courts in Oz a joke

Our so called learned courts have elected to assign a 5 year prison sentence to a dog druggie after he assaulted and killed a helpless old lady during a mugging - He has 3 years to serve.
Are the courts really in touch what is going on for **** sake!!!!!!!!!!
This has really angered me .

Three years for assault is actually a pretty long sentance. In this country over two years would be unsual. I assume you are falling into the usual trap and and confusing what happened with what the person was found guilty of. You've not given a link so I can't investigate, but I assume manslaughter charges were either not brought, or failed. That being the case, the sentance is for assault - and assault only. The fact the woman died does not enter the equation. Bad? Yes, but it's the law.

I always thought that if someone died as the direct result of an offence against their person then it was murder, not manslaughter, and the onus was on the defence to prove that there was no intent?

I'm willing to be corrected, though.

Regardless of the legalalities, I know it will be come the revolution. Actually, that gives me an idea...

Simon, in England and Wales IIRC for an offence to be murder you need intent to commit GBH. So intent only for assault or ABH would result in a conviction for manslaughter. Unless the law's changed in 15 yrs (likely!)

I thought the only difference between manslaughter and murder was that murder is premeditated? Or am I wrong on that one.
