Default REJECTING A CAR THAT NOW 10 MONTHS OLD

OK. MY VW GOLF GTI is now 10 months old and has done 6,500 miles
I am looking to reject the car as its been in and out of dealers since new.
My supplying dealer has now gone and have to use another dealer.

The problems with my car have been endless.

ABS cutting in
New Alarm
New Alarm wiring
New door window motor
New head lamp sensor
New Rear wiper motor
New steering modual
The headlights have a mind of there own, as do the wipers
The Seatbelt warning light come on and off
The airbag light comes on and off (VW say this is impossible)

VW customer care have actualy been quite good and i have gone along with them trying to work out all the problems, but have now come to the end of my teather with this car.
I want to reject it,but VW customer care say this isnt possible ?
What is my next step ?

I have ordered another car with a new VW dealer and VW customer care have made a good will gesture and paid for a option i have fitted.

They have since had my car for a further 2 days and still not sorted the problem out. I want out of the car but they are having none of it.
And im gonna tell the dealer to get stuffed and by something eles

Can you offer any help in finding a way to get his car backed to the manufacture ?

Even under new legislation I believe that you would struggle to reject the vehicle and receive a refund. At this juncture the only option for you is to establish that the faults were present from manufacture (for the first six month the retailer had to prove that they werent) and then seek compensation from the retailer. The level of this compensation isnt limited though. You really need to speak to a solicitor, try your home insurance first.

To see if you have legal cover, not ask them to pay for the car!

If you have the car on finance phone the finance company, they legally own the car until you've paid the balance so if you tell them the problems they should help sort it out for you

contact auto express, have a decent documented case, bill reciepts pictures of the non exsistant faults ( always a clincher)

failing that park it accross the drive of Vw,s chief executive and contact the press, wait for the bib to come in and make sure lots of photo,s are taken.
nothing like a bit of bad PR

Question

I can't answer your question I'm afraid, but I am very curious as to why you bought another VW?

Have you considered registering on every car forum you can find, thus forcing VW to make amends for fear of bad publicity?

I think the Auto Experss, Auto Car or BBC Top Gear might be your best bet, get some decent publicity, also is there not a trading standards programme on TV with Ann Robinson?, one problem i can see you having is the fact the garage are trying [maybe not hard enough] to help you resolve the issue, but then from your point of wiew they keep having the car and arn't sorting the problems your having.

It does sound like they're ding a trial and error procedure, a case of well it might be this so change it, then when it doesn't work they change some thing else

Quote the Sale of Goods Act:

Not fit for purpose
Not reasonably durable

Just been through this with a 4 x 4 manufacturer. They twist and turn like a twisty turney thing, but get around to sorting it in the end. Situation not helped by your dealer going under as the contract of sale is actually between you and the dealer.

In my case they have offered to buy the car back at a "fair price" and give me a substantial discount on a new one.
