Default pls help re BALIF's commercial debt etc etc

ok long one this so bare with me, a friend of mine in the recovery business is going under, had a knock form the balifs and they came round and logged all the gear he had, so now basicly hes left the workshop taken all his gear and is telling them to **** off lol


the thing is he has offered me his recovery truck cheap as chips and its so tempting, just trying to find out the rights as the baliffs have recorded his possesions and the truck is one of them, he said hes willing to write receipts bill sale etc etc and if i wish to date the receipt prior to the balifs turning up, so.......

will they try take the truck off someone else if he happened to sell it to a genuine punter in good faith???or will they just hammer him for selling the goods when hes not spost to?
technicly it has no outstanding debts itself, its not there possesion until they had actualy siezed it


i have to give an answer on this tomorrow, my plans were to buy it and leave it in storage for a month whilst it gets registered in my name etc etc

anyones thoughts greatly apreciated

cant you just HPI it?

Dont they gurantee that it has no outstanding finance, not stolen etc etc and your covered for up to £15k (used to be, dont know about now)

I would HPI it anyway for all you know it could have finance owed on it, people sometimes strtch the truth when they are desperate.

If the baliffs come and ask you for details about how much you paid etc etc then tell them you saw it advertised at the side of the road, never met the guy before etc etc

Depending on who he owes money too (Inland Revenue?) then disposing of assets cheaply is an offence and they probably could recover it.

its 6 mts rent owed and yes naturally i planned to hpi it

if he is made bankrupt then the OR or trustee would be able to recover the vehicle as a transaction at an under value under section 339 of the Insolvency act.

You would be left out of pocket then, or with a legal bill atleast.

not gone that far as yet he only had one visit from the bailif, its his landlord thats after him for the rent and hes now vacated the premises

If theyve taken walking possession then he cant sell it; if he does then he answers to the court, but you keep the truck assuming that you dont enter the transaction knowing about the baliff's claim.

.....unless the vehicle has a substantial fault which affects its value substantially of course.....

Also, are they really baliffs? For baliffs to come and take walking possession then he would have had to have been to county court already..... If not then theres little they can do.

the truck has no mot no tax hence why i bought it cheap

not all of em m8 plus theres very strict rules about the use of mot exemp trucks hence quite a few are mot'd
