Sold a car, now getting grief.
Hi guys, I sold a car of mine privately about 3 weeks ago. Problem is the guy I sold it to is claiming i've sold him a duff motor.
The problem which I was told by a mechanic friend of mine was that the brake disc shield which was rubbing on the disc when it got hot which I explained to the new owner. He looked happy enough with the explanation and we did a deal. I also took a car off him as a part exchange.
Yesterday I then recieved a text message saying, 'Thanks mate that little noise on the brake shield has just cost me £400. It's been bodged up as you well know so it could be sold. No way it passed an Mot in that state. Trading standards will be in touch with you and the Mot centre. Good job I did not put sold as seen on the receipt that you signed.'
Well that really annoyed me as I payed £280 to get the bloody thing through it's mot which was a month previous to it being sold.
On the original receipt which we used for the deposit I did write sold as seen tried and tested.
So guys where do you think I stand? Personally I think the sold as seen bit is just a load of crap anyway.

if it was a private sale tell him to **** off....

You have nothing legally to worry about.
You sold the car in good faith, and explained the defaults as you knew them to be.
Your reciepts from the garage should hold you in good stead, but as it was "sold as seen" that is really your get out of jail free card.
Don't respond to his texts & wait for any paper work that mght turn up - which I doubt will.

As much as its a concern to you, its tough luck! Used cars dont last forever.... If he wants a new car, then he should of bought one. As for the MOT, the test is done on the day and if its OK it passes. No-ones at fault if things go wrong afterwards. I'd imagine he's probably been told that while your reading this. If he wants to get finnicky, then pick out a load of faults on his old car and ask him what he's going to do about that!

Ignore him as it's hardly a convincing attempt to display his seriousness, via text.
Mind you, part of me would love to reply with " Sorry, can you tell me which car it was and exactly when I sold it to you as I've cleared a few in the last 12 months"

Keep your receipts for MOT work to make it pass.
Nothing else to worry about though nuyers of private sales DO have rights, contrary to some pots on this thread. As long as you have the receipts, bollards to him!!

'It's been bodged up as you well know so it could be sold.' - Is this true? Sounds like you stated there was a problem with the brake and he still bought it so his problem. If you did bodge it then it's down to your conscience.

Don't reply to his text. Do not get into any correspondance with him until you get the paperwork through the door or a visit from trading standards (which you wont be by the sound of things).

cracking replies!! In answer to the bodging, no i'd not had it bodgedat all. I wouldn't want to risk driving around in a motor that had not been properly repaired let alone sell it to someone who was none the wiser.
