HELP!!! expert on sales of goods act needed!!
i purchased a Toshiba rear projection tv from comet on 18/11/2003. since i had it there has been a problem with the convergence, in that the red gun keeps going out of alignment every 24hours. i thought i'd better get this sorted and had an engineer out.
the engineer fumbled with the remote for about 5 minutes until i showed him the screen he needed to get to. he then spent 10 minutes aligninig it all before announcing he'd sorted it1
i pointed out to him thats what i do every day, it will be out of alignment tomorrow.
he then phoned a friend, who advised him to take the back off and look inside( at this point im becoming quite concerned!)
he does this and says 'oh i see the problem, its got as dry joint'.
he then starts soldering away.
10 minutes later, i hear him on the phone saying' it worked before, its not working now' , before advising me 'the whole circuit board is faulty and needs to go to the workshop, dont turn it on' !
comet have told me they will not replace it as i have requested, and they will not pick it up for repair until next wednesday!
the tv before he touched it was working, although the red gun was going out of alignment it was watchable. it will now not even turn on!
i am now not confident they could repair this set judging by the technician they have sent and want a replacement which they have point blank refused!
im tearing my hair out with them!
any advice anybody can give me will be gratefully recieved!

Considering its a bank holiday next Wednesday aint too bad.I think you have to give them a chance to fix it.
You say you bought it 5 months ago,have you had this convergance problem since then,if so why havent you had it fixed earlier?

By accepting a repair you have made it very difficult to reject the thing under the sale of goods act. Also carrying on using the thing while it was faulty has further weakened your case. The best course of action is to reject a product as soon as possible and dump it on their doorstep if necessary -although this is not an easy option.
I'd try contacting their head office if I was you as well as various consumer groups/TV programs and see if it gets you anywhere. Be prepared to fight- the company you mention is notorious for being a bunch of c**ts.

Its 5 months old,i think its fair of them to be given the chance to repair it.

i had the same problem about 5 years ago
bought a pc from sainsburys and within 3 months the hard drive went
i went back demanding my money and they refused offering to repair it
only when my missus who is a solicitor had a word did they cough up
argue its not fit for the purpose it was sold and even when they sent out a repairman it still doesnt work
enough is enough and you want your money back
or go to citizens advice bureau if comet still wont budge
they can be awkward buggers and try to fob you off unless you have a real understanding of the legal area

Depends how hard you want to push it and how much of an difficult ****** you can be. I've had refunds on kit that's of a similar age, it just involved a few faxes to head office and some grade 'A' complaining.
As for an onsite engineer arriving, he's probably the guy they send out to do hi-fi's, TV's, DVD's etc not a specialist. It's hardly a surprise he didn't know what he was doing. He's just there to weed out the dope *** motherfcukers who can't work out when something is plugged in or not.

Comet are sh**e.Our cooker blew up in Nov last year.got on to insurers who gave us the go ahead to buy another so we could get back to cooking proper food. other than eating takaways every night and nuking everything else.Off we trot to comet,see a good deal and order it,DELIVERY DATE-21st Dec,think its to good to miss so put up with micro for two weeks,then phone call from Comet---------- Sorry Sir your new cooker cannot be delivered till new year.Iwent Bush,having invited ppl round for Xmas dinner we now had to scrounge our own from the OUT-laws.made a big stink but was told to basically get on with it and it took us a lot of hassle to cancel the order.Refuse to even step in a comet now.wan**rs.sorry to go off topic ,but i know how u feel.

As Nacro stated, as you have accepted a repair, you cannot technically reject the product.
however you could argue that the set worked , albeit with a fault before the "Engineer had a go"
your three options are now...
accept a repair and go for some suitable compo
(never my favorite option)
kick up stink, and state not fit for purpose not of merchantable quality etc..
as mr engineer killed said set, short of a complete new system, how do you know what other damage he may have done..
i had a video, that i had a new set of heads fitted by an engineer (hitatchi)
the head failed a further 3 times,, the engineer then rang the store manager and told him he was a pratt, and the customer was entitled to a new video recorder,, bought a tosh and it was perfect..
we had a tv we bought from dixons as a guaranteed exchange product, it had been repaired...
it died withina week, we called out mastercare who turned up...
had no idea what he was doing,, wrote down the decoded flashes i had noted onto the job recipiet, and stated it needs a new ic i will order one and disappeared...
weeks passed and nothing
weeks passed and my mrs was giving it the if you dont ring up it wont get fixed, then the guarantee will expire etc..
i checked the date and yup 1 month had passed,, i rang mastercare and stated that under the terms of there repair charter they had failed...
(all repairs will be completed within 1 month or a replacement set will be given)
a quick check revealed that the part was on order... but under the charter yes, i was entitled to a new tv... got authorisation number and went back to dixons....
oh dear that model is discontinued... (SONY!!) so we,ll have to give you the next model up FOC and we,ll start a new 4 yr guarantee from today...
result...

just make enough noise,, it works

If the fault is only minor and can easily be put right it is reasonable to accept a repair. This won't stop you claiming a refund if the repair turns out to be unsatisfactory.
what do you think?

Have one too - PSU went just within warranty some 2yrs ago, other than that fab pics (weak sound).
Do you have a dog?
I ask since every time mine gives it a whack I have to re-set the convergence! Maybe you have rug rats bouncing off it? Just a thought as that is an odd fault! (PMSL at MrDry Joint!)
As an aside, do you know how long you can expect the lamps to last - mines on a lot...

I won't use Comet either. Bought a dishwasher a few years back with a warranty costing £100 or so. If after 5 years you return the certificate within 1 month of expiry you get refund.
So returned certificate, posted it the day after warranty expired, and waited, and waited, and waited. i the end rang them up and they said the claim was invalid as certificate not received within 30 days of expiry. WTF sent it in plenty of time. Wished i'd used recorded, but hey live and learn.
