Default problems with car after buying from dealership

hi guys

im just going to run through a scenario, could you tell me what rights i would have exactly please and the best way to play it.

i purchase a car from a well know dealership/franchise for between £25k-£30k, comes with their 3 month warranty.
i take car to a specialist for an inspection/health check and they tell me that the car has a few (common) issues which require engine removal to repair. car is still useable.
the bill to rectify these issues is around £3k

what would be my next move? i would only want the work completed by the specialist NOT the dealership that sold it me. i paid for part of the car via a deposit via credit card (£1k) the rest was paid by BACS transfer
would it be best i go back to the dealership and threaten with returning the car?

cheers guys

If bought from a dealer I'm pretty sure you'll find its six month warranty whether they like it or not.

thing is I wouldn't want them fixed by the dealer, i would want them done by the specialist.
I've asked for a list of all the service history on the car and also all the receipts with it as they may have already been done already.

Were the problems there as soon as you bought it shrek? Or did they appear after a short while?

In that scenario you've seven days to leave it back no questions asked. Get it get your inspections done and if not acceptable return it.

im expecting it to have the faults, its a low mileage standard car (52k) on a 2008 plate and has had only 2 owners and a clean mot history however the faults are age related where things perish and fail but due to nature of the car they are a ****ing ball-ache to fix, other than that they are pretty bullet proof.

according to consumer rights if the car goes wrong within 30 days i can return for a full refund. but a fault with a car doesnt mean its a faulty car.
i will see what comes through on the service history/paperwork that i have asked for.

I don't think this is correct. If it goes wrong in 30days they have to try and fix it 3 times before yoy get your refund.

Don't agree with that at all, I daily a near 16 year old jeep that spent 2 years down a quarry as a work vehicle and has covered 150k, I've ran it daily for 3 years 6 days a week and it has never ever gone wrong. I give it death aswell.

my father in law hasn't had much luck with his 14 plate diesel bmw 3 series which has a less than 60k on it

I would buy my own warranty as lot of the ones suppled by dealers are sometimes not even worth the paper they’re written on.

they are out of my range now, easily gone up £8k-£10k in the last 12 months. This time last year a 2014 comp pack with sub 40k on would be around £28k, all £28k will help you now is a bare-bones 13/14 plate with no decent options and over 60k on the clock.
prices have gone mad.
Even a none comp pack 15 plate with a few tasty options and sub 40k is around £37k it's ridiculous

I don't think any of the aftermarket ones are much better, always some sort of jargon about wear and tear etc.

So you haven't picked the car up yet and found a list of common issues with that model and are now concerned the car you are buying COULD have these issues? As you already mentioned, talk to the dealer and ask if the issues have already been fixed. If not then either negotiate for the dealer to fix them or walk away.

In my opinion it's unrealistic to ask the dealer to drop their price £3k after you have already made a deal for issues the car might not even have. Give the dealer the chance to investigate, but be aware the dealer may pull out if you make the deal financially non-viable and you may lose the car. It's your decision.

You would have to give the dealer a chance to fix any fault before going to a specialist. They have to fix it if it was within six months of purchase.
You could speak to the dealer and ask if they could come to some arrangement with the specialist.

This article from the government archives, outlines the responsibilities car dealers have. Its old, but most of it is still valid.
