Are you checking the level when the engine is hot or cold? The level appears to rise when the oil is warm, for quite a few hours after running.

Are you sure the dipstick tube is clear of residual oil? The Scooby dipstick tube has a habit of holding a false level unless you clear it, either by blowing through it or leaving the dipstick out for at least 5 minutes.

I'd go for the injector o-ring leak too, fills the oil up quite quickly. If this is the case, you'd best get it fixed soon, or you may end up getting a hydraulic lock, Is the engine a little hard to turn over?

thanks for the replys guys, the engine was hot at the time so i drained some out as i didnt want to cause any problems i.e hydrolic lock, im keeping a close eye on it at the moment. the fuel ecomony dosent seem any different to usual (180 miles to a tank) so if it is a leaking injector it must have been like it since ive had the car which is about 3000 miles ago. thanks again.

A hydraulic lock is when the injector leaks fuel into the cylinder, filling it to a point when the engine can't turn over, as fuel doesn't compress.
This has the effect of forcing the fuel past the rings, into the oil. If it's a slow leak, then the fuel will get into the oil, without the lock.

Fuel dilution can be caused by a number of things, it wrecks the oil so change it.

There are a few possible causes.

Leaking injectors
Excessive idle time
Incomplete combustion
Cool engine temps
Short trip driving
Chips and mods
Restricted air filter/fuel to air ratio wrong
Worn piston rings - excessive blow-by
Fuel pump over fuelling
Seals/gaskets
Improper injector timing
