Default Games Returns/Refund policy

My better half purchased a used copy of Fable II for the 360 recently from Game. The disk was faulty (wouldn't even boot up) so she took it back the next day and, when told they had no other copies to replace it with, she asked for a refund. They basically told her that it is not Games policy to offer refunds for faulty goods and that she had to choose another title. Yes, she tried arguing her statutory rights etc but they wouldn't have it and in the end had to choose a different game.

So my question is what they did legal ? I was under the impression that she was within her legal rights to ask for a full refund. If this is the case then are Game breaking the law by refusing ?

Ok I asked my mate who worked for game up until 6 months ago:

His reply was that on a faulty product they are alwasy told to try and offer the person another title but because it is faulty they do have to give a refund, its illegal not to. Essentially their aim is never to give money back but if thats what the customer wanted then they had to do it.

We won't be buying anymore stuff from them from now on. I stopped trading in games there a while ago due to the price offered being a blatant rip off -
last relatively new game I traded I got £6 for it - looked in the pre-owned section and there it is for £24. I know they are a buisness and expect to make money but that is an insult. Even some of the pre-owned titles are silly prices - £18 for 'Dead Rising' (the original) surely a 5 year old game by now.

Fat Chris used to work in my local Game.

edit: sorry that was Gamestation (now taken over by Game)

I ordered a copy of Dead Space 2 last sunday

Still never turned up and they (shopto.net) want me to wait 15 days before logging a lost parcel ?

They still advertise "shop late, play tommorow" on the website banner.

I only ordered from them as my local games shop had ran out of copys

To clear this up, you have a legal statutory right to a full refund.

As Dedrater says they should have refunded you the money........I guess it depends on the store as to how they handle things.

Here in sleepy Carlisle the Game store is very helpful

Yeah this is where they make a lot of their cash is trade ins etc, just the way they choose to do business I guess.
