Everyone does it really...not all the time...just sometimes...you just have be ready for the concequences if something goes wrong..


Did you hear about that old Lady that got run over and killed? This guy was undertaking doing 50 in a 40 zone and knocked her over and she died...

The worst bit was he only got a £250 fine and Baned for 2 years (Read it in the papers yesterday)

 

With all due respect, it was mindbendingly stupid to do that kind of speed in a 30 mph limit regardless of the road conditions or layout.

I don't give much for his chances and neither does his solicitor by the looks of it!

Don't think you saw the point of my post Reality. I did not actually pass an opinion on the speed that he was doing, purely how stupid it was to do it in a 30 limit. Neither did I in any way attempt to justify the speed driven by the copper. I presume you mean the one who was "familiarising himself" with his traffic car. There is no way that could be justified!

I also think it's highly unlikely this was a one off, he probably does it every day and this time got caught.

67 in a 30 is just too much, whatever the circumstances IMO. If he had run over a kid at that speed, he'd be looking at a serious stretch now.

 

the end of the day, near motorway speeds were being done in what is in effect a built up area. Your brother deserves what he gets, its irresponsible. An astra sxi I imagine would be accelerating a fair bit before getting to the national speed limit sign and even then he was exceeding it.
The magistrates will be much better if your bro admits the speeding, I think it is just a case of damage limitation.

Yes - but he's being told to admit dangerous driving.

If he admits to that he could end up in jail (as far as I understand it).

If he was being asked to admit to speeding then fair point.

And Les, this is the point I was making. Driving a car at 67 in a 30 is definately speeding - wether or not it's dangerous depends on a lot of factors.

If the guy had a decent solicitor my guess is he would end up getting the points & fine for speeding - not for dangerous driving !

18 years ago - I got caught doing 68 in a 30 Zone (not big or clever, I know) - and walked away with no ban - 3 points and a £120 fine!

However 101mph on a dual carriageway - 7 years ago and I wasn't so lucky ....
- 14 day ban, £220 fine and no points

You can be unlucky - but having a good solicitor, wearing a very smart dark suit, being repentant and speaking the queens english works wonders .......

Yes of course it may or not be dangerous Reality, but that cuts no ice with the authorities if they catch you at it, whatever the road conditions, Thats why I said it was stupid and also why I said that I did not give much for his chances. I agree though that I am surprised at the lawyer's advice unless there are other reasons we do not know about.

Is it Ok to run over a kid on the motorway while doing 70mph then? What about at 60mph on a country road? Or is it more important that the person assesses what's going on around them and drives accordingly?

 

I meant just to admit to speeding not dangerous driving. Although by the amount he was exceeding the speed the magistrates//courts may see it as dangerous driving anyway.
If I was a magistrate, I would maybe think hmm doing 67 in a 30, he was just about to enter a 60 zone so what speed would he be doing there (bearing in mind he was already exeeding the national speed limit in a 30 zone). I think the only way of getting off with it is to find some loophole, but to be honest he should just take the deserved punishment that we know he is guilty of (speeding), the dangerous driving would just be down to the cops word against his.

 

i admited to doing 61 in a 30 in court. However explained to them that i did not realise i was going that fast as i was driving a SMART CAR Told them it was a clear day with no other cars around, and the road had two lanes...

I got banned for 2 month and a fine...which i did not think was tooo bad...

Since then my brakes have been really good alongside my sight...

 

Trouble is, the courts don't really pay too much attention if it was a clear road and no traffic etc. They are only interested in the fact that you exceeded the speed limit designated for that stretch of road and if you did then they have got you and will sentence you according to the figures etc regardless if it was safe or not.
