Default In need of some advice.

Since i have been living in swansea matina i have had a car parking spot under ground. Great. But this has caused all my problems.

The car has had what looks like hard water (limescale) dripping on the paint and windows. I have phoned the maintainance manager for the area and he said that he had had this before and that the liability insurance will cover it. Great.

Phoned the incurance company and they told me quite roudly that i had to go through my car insurance. Ok, phone my car insurance up and basicly they will right my car off rather than repair it.

Can i use a third party solicitor to claim for the damage to my car without going through my car insurace??

Any info would be much appriciated.

I don't know how much you have been quoted for the respray but surely it can't be enough to mean the car will be written off?

The liability for the paint fault is entirely with the building and as such surely they must have some procedures in place to pay for damage, the same as if a roof sheet fell off and damaged your car.

I would speak to the company responsible for the flats, surely if you produce some quotations for the work to be carried out then they can either repay you or pay the repair centre directly.

The thing to remember that even if you are not at fault some car insurance company's still penalise you for even 'no fault' claims, it happened to me 4 years ago and it still affects my policy now.

Spoke to the claims department and explained exactly what had happened and they said that the value of the car was too low to warrent a full respray. They also said they wouldn't bother claiming off the other party as the cost would escalate. Plus i would be penalised for the claim for 5 years

Lee, I could polish the damage out but i'd need to be agressive and the paint on the car is painfully thin.

I have the same with my96 thinning on top! Living with it for now as I'd like a full re-spray one day but I'd also like a million quid so I could afford to do it Come on Lotto

In other words what they are saying is 'it is too much work for us to claim the value back from the other insurance company', I would contact their customer services dept and threaten to get the insurance ombudsman involved.

I know how you feel - not your fault and yet your the one being penalised now and in the future (plus of course there is your excess on top as well).

Let a pro detailer check it out Dylan, it may be that a good clay followed by a paint correction could remove this, maybe a couple of hundred pound or slightly more.

First thing I would try and do is take pictures of the damage and the garage (which you have probably done). Get a written admission of liability from the maintenance manager from your accomodation. Then write a letter to the insurance company along with copies of admission and pics to request they sort it. Hopefully they will admit liability (given the admission from the mainenance manager) and send a claim form and the like.

If they then play hard ball then it's independant assessor on the building and damage caused to your RA. Then get legal representation to handle your case. It's a ball ache for sure Dylan but the insurance industry makes it a pain to avaoid paying out at all costs.

Anyone else in your block who has had similar damage? If so, it may well be worth getting the same solicitor to make an approach to the buildings insurance company.

As for claying, yes this maybe an option, but why should Dylan have to pay for it. Defeatist attitude. Don't let the b4stards get away with it......and relax

Definately get in touch with the owners of the building. Like said above, a pro detailer could probably sort it but you would have to pay

Speak to the owners and get them to sort it.

You could always pursue them in the small claims court - especially as the Manager has admitted liability to you, get that in writing as said before and maybe they will get it sorted for you - have you any legal cover with the insurance you have, be it car or property - praps they will advise you, if you have the legal cover, for representing you for the claim.

Get on to "The Ferret" or "X-Ray" or similar local consumer advice programme. X Ray have already covered the poor build quality on the flats down the Marina.

Check the small print on the lease of the flat, my daughter works for a letting agent in Cardiff and there may be some hidden rules applied. It may say you park in the car park at your own risk - legal cop-out.

Liability has to lie with the landlord or persons owning the building.

Why should you claim off your insurance for something that is not your doing.


In the mean time line the roof of the garage with plastic sheeting to prevent further damage.

A paint correction specialist may well cure the problem without the need for repainting, worth a try.

as said why should you claim through your car insurance, its the flats insurance companys way of not paying out, i would ring them back up and ask for the manager not a telephone sales monkey then tell them the car was "off the road" so it wasnt insured as it was "in storage in your off road parking space" (unless it states that any car parked in your space must be insured/taxed/moted etc as some leting companys insist on)
hope you get it sorted,

you know there is another option............................................

I use a cracking 'Claims management company' who have worked well for me twice and never cost me anything upfront and they do all the legwork. Do you want me to PM you their number?

Hi Dylan, couldn't text you back yesterday as yet another one of my mobiles is f**ked!!!!! The company i have used a couple of times is called Radar Claims and the chap i used to speak to was Matthew, his number is 07880 794300.
On both occasions they were superb and i didn't have to even bother my own insurance company. Give them a try, any probs getting hold of them and i'll dig out a landline for you

Big Thank You to dave at ESP. He put me onto a third party claims company from cardiff called Radar Claims Management. If you have had an accident in the car and it wasnt your fault use these guys, that way you dont affect your own no claims bonus.

Once the claim is accepted it'll be heading for Old School Engineering for a full respray and something a lil special hopefully, fingers crossed.
