advice please!!!!
I will set the scene!!
Needing some advice regards the garage doing work on my scooby, its been there over 7 weeks now with an over heating problem which as been tracked down to the heater matrix being blocked, not a problem told them to bypass it.
Its now sat there for a good 5 weeks with no work being carried out on it, hasnt turned a wheel, and is still in bits, ive spoke to the bloke who owns that garage and he said he will get round to doing it when he gets time, but to me this seems to be a joke.
He said he as had loads of work in and hasnt had time, but surely in the 5 weeks since the problem was found, he should have had enough time to pull 2 pipes off, join them togeather and refit the intercooler.
I spoke to him today to say i was going to remove it, as i was not happy with his progress and his work manship, he has now hit me with a bill for the work done so far (not a problem he did do that work) and than a massive bill for storage.
Do you think this is right????
Cheers wiggy1

Bugger that Wiggy,
if it were mine, i would pay for what he has done, but no way would a pay for storage.
Especially if he already admitted that he aint had the time to do it.
How can he charge for that?
TBH there's no way i would have left it there that long, 1 or 2 weeks max.
Plenty of other garages could do that for you mate, go get the bugger back

that is so wrong but there isn't alot you can do. You have toclear the bill then go to small claims court to recover some of your money, but if the bill is not clear hr can hold your car until it is cleared or he goes to small claims and takes your car for payment. They are some joker's out there i'm afraid.

You need to pay him for the work before you can take the car.....google lien and right of retention ( I guess you are not in scotland).
He can't charge storage if it's on a public road and he can't charge storage unless you agree to it. Plod can charge if they remove the car for an offence but that's different.

Unless he said to you at the outset that he wouldn't have time to sort it for that long then I have to agree with everyone above that 7 weeks is a **** take and trying to charge storage for a car that's sat on the street is even more of a **** take.

Scottish law is a bit stronger than english law when it comes to a lien IIRC........ he can hold onto your car until you pay and also sort out the matter of the storage charges
Shaun
Lien
In Scotland a lien is a right, founded on possession, to retain property until some debt or other obligation is satisfied. Liens are classed as general or special.
A general lien is a right to retain a client's property until balances or debts due from the client in respect of all similar contracts are settled. A special lien is a right implied by law to retain an article received in the course of a particular contract against the payment of a debt arising under that contract.

If I was you I'd get the car back as soon as possible, even if it means a tow truck. Trust me, I've had experience with this kind of thing unfortunately
