Default Stolen but disbelieved

Hello all,

My brother had his car stolen and recovered not too long ago, it was found in london and had ran out of petrol. There was some damage to the car and is now back home in a body shop garage...

Now the thing is the insurance is saying that the car could not possibly of been stolen as it has transponder system with the keys...

My brother has got both keys still and is not the kind to fake this sort of thing (his a dr, so no need )

The insurance people have treated him like a criminal and making out he has smashed his passenger window and pretended to have his car stolen as there is no damage to the key barrel etc!

My belief is pretty much any car can be stolen.... Is there anything which can aid my brother in proving this and not have his claim thrown out???

**also some of the damage on the car which no one can work out is that the boot seems to have been sanded down with sandpaper maybe right next to the bmw badge?! Why would this be?

Can he prove his whereabouts at the time of theft ?

Was the car finger printed when recovered ?

yes he can prove as he was at a lecture....

and im not sure about the finger prints, will need to ask him.

But im sure its possible to steal without a key

if they're claiming that the car can't be stolen because it has a transponder system then they need their heads checking (though obviously they are just trying to get out of paying up). Anything can be stolen, any security system can be breached and bypassed by someone determined enough.

Yer Norwich Union are claiming this and are 100% that a car with a transponder system can not be driven without the keys!

They are trying it on seek legal advice and a letter from the solicitors and they will give in and **** them selfs!

I take it that it was reported as a crime? What were the police findings on this?

a few years back i had a bmw (1999 - 3 series) had a faulty factory (transponder key based) immobilisers/alarm. so i decided to fit a Clifford alarm.

anyway, within an hour i had done some research on the web and and completely disabled the factory immobilisers.

point is, i have a fair understanding and ability when it comes to auto electrics and it took me a relatively short time. Somebody with experience and in depth knowledge would be able to disable the security in no time.

Get him to speak to them again and inform them that if this isn't sorted out to his satisfaction within 7 working days (or something like that), he'll be contacting the Insurance Ombudsman with a FORMAL complaint.

Plug in a "plug and play" apexi PFC with a nice safe base map already on it, and you can drive the car without an issue ?

iirc they remove the uk turbo security ?

takes a few mins to fit one with a ratchet as well!

My son works for a large vehicle recovery company, which recovers all police type work, & it is quite alarming when he has access to information that can start & remove, with no keys etc 99% of all cars within 3 to 7 mins, without any damage etc.
Insurance companies know this as they are usually the ones paying for this service.

ignore all the advice above except one thing.
Get legal advice pronto.

No amount of "well the good people of scoobynet reckon..." will get NU to change their minds I can promise you that much

Same old faces saying "tell them this" and "insist on that" which doesn't amount to **** except bravado.


In all honesty, other to try to make yourself (or in this case your brother) feel better, I cannot for the life of me understand why you would ask for advice on an internet forum.

doubtful my "solution" would work then, although it shows just how easy his kind of thing can happen!
