Rear upper brake light- MOT requirement?

Default Rear upper brake light- MOT requirement?

I have a Scott Lowe carbon spoiler fitted

so no brake light as fitted in the top of the original STI spoiler

Will this get pulled up at the MOT?

If it doesn't have one, no.
If it does and it doesn't work, yes.

If it does have one and it dosen't work then no, deemed as cosmetic only (no dismantling to allow to see if it's connected)

If it does have one and it works 50% or more must be visible or illuminated.

UKMOT.com MOT Manual 1.3 Brakes lights

Says on there that any additional stop lights must be tested, not a legal requirement to have one though. If Nick above is an MoT tester though i'd go by what he says.

My daily drive just passed its test with an inop high level break lamp, i asked the tester and he said it dos'nt need to work.
