Default Car buying scam

I'm currently selling my Impreza in the autotrader, and today I received an email from someone who is interested in it asking for more pics, which I sent.

He then sent me another Email saying he will give me £200 more than the asking price to cover the selling fees, which I started having doubts and not sure what to do, so called a police officer friend who said to avoid like the plague as it's a scam.

then the guy sends me yet another Email:

This scam is so prevalent, Autotrader even warn you about it in the bumf they send you when you place the advert.

I've had two in 4 weeks.

Someone remind me how this bankdraft scam works please. If you accept the draft, and call up the issuing bank to see if its legit, then once it has cleared in your account that should be it right?

I know in the past people have given fake drafts that banks have accepted, and then later realised and taken your cash away again.

Is there really no other way than paying by cash that is secure (and that assumes you check that the cash is not fake).

Make sure you use a fake email address before you charge off shouting at this guy...

...he is only going to sign you up to more spam services, disposable emails addresses are the way forward for this one

This kind of scam works by offering to pay more, due to them using a "shipping" agent. What they do is get a bakers draft, sometime fake sometimes real (so checking on the bankers draft doesn't safeguard you) for more than the value of the car. You are then asked to pay the excess balance to the shipping agent, who turns up with documentation prior to collection. It all seems fair enough, you've got the draft in your account by this time, so you pay them whatever excess and you shouldn't be out off pocket.

So the collection agent disappears with the excess payment you made promising to return on whatever day arranged only they're never seen again. In the meantime, the fake bankers draft fails to clear obviously (if you didn't check up) and if it's a real draft it can take upto 10 days to clear giving the crooks ample time to put a stop on it. Either way, you're out of pocket by whatever excess you coughed up.

Although this looks to be slightly different telling you to wait until cleared before coughing up. I presume what will actually happen is the "shipping agent" will turn up earlier than expected, and talk you into parting with your own cash upfront and just to pocket the difference when the draft clears (which it won't) or if it does, will shortly be reclaimed!

MMmmmmmm, it is a jungle out there that's for sure. I never realised that a draft could be cancelled. Thought the whole point of them was to make sure this could not happen.

Just found this link, which is a little scary:
Bankers Draft

1) They pay with fake draft and get your car
2) You realise you have been scammed, and then find out your car is not insured for loss through deception
3) The crooks sell your car before you report the theft, meaning the police cannot repossess your own car even if they find it....nice . Who makes up these laws

Ive sold 2 imprezas and both times ive had loads of con emails from autotrader but nothing from ebay, i thought it would be ebay that id get the dodgey mails from.

I always get emails written in reeeeally bad english, crap grammar, bad spellings etc. The best one was from reverend jim wanting to buy the car for his sick daughter!!! every email was saying if id just like to send my barclays bank account details to them then they would transfer the money and a client of theirs would pick the car up.

even when i said i didnt have barclays account and i wouldnt give it to robbing pr**s like you, they still kept trying!!!

beware the nigerians are out there!!!

thanks for the info, its all noted down

the one rule i have is never accepting drafts as cash, if someone wants to pay by draft, it has to clear at the bank before goods are handed over, which usually means i get paid cash,
people argue its as good as cash, ??
my answer is; the banks want 5 working days to clear it, if they don't want the risk , how can anyone else, they are not as good as cash full stop!!!!!!!
treat like a cheque, and usually you will be ok

safer with scottish notes !!

oh **** not that arguement again

Put a clause in saying that the car will not be released for 11 working days if paid with by bankers draft, this gives plenty of time for the draft to show up as dodgy.

Apparently what happens is that the bankers draft WILL clear, so you give the "buyer" the remainder off the balance, which in my case would be £4300 (£6700 agreed car price - £11000 draft amount) then the police comes knocking on the door informing you that the funds were stolen, so I'd have to pay back the full £11000, so in the end would of lost the car and be out of pocket for the £4300

I never give out postcode to potential buyers, always meet them nearby to view the car then take them home to view paperwork if they look OK & appear serious. Never had any problems with this ...

That sounds a good idea will do that, if the buyer is genuine, then it shouldn't be a problem

These scams will be around forever, because, if you are not wise to it, you can still get caught.
I'm too lazy to read all of the replies, so it may have been mentioned:
Most of these e-mails are copied and pasted, this guy, Paul Walker (Star of The Fast and Furious 1 + 2 ) hasn't even bothered to change the template where CAR = The model of your car. It's better worded than some I have seen, as they used to begin to wish your familys dogs brother eternal happiness before they got down to the scamming.

Autotrader would tell people not to come and look at your car though because you could be a trader pretending to be private or the car could be stolen or you could get your own car hijacked if you've met in a car park somewhere so you can't win!

I just say that I don't give my postcode to strangers. If they are serious they will go to the trouble of meeting as I've said they can come back to my house to view the p/work. As for h/jacking the car ... if I turned up & it was a car full of nutters waiting for me than I'd just leave! Always meet in a public place anyway ie not in the woods somewhere

Had the same thing when I was selling my Rover, after the third email I sent a reply calling the guy all the names under the sun and some new ones for good measure, then threatened to use my contact to hurt the guys family if he emailed me again...didn't hear from him again.

It was so obviously a scam as the guy said he was an agent for another guy and didn't need to see the car as he "trusted me" but did request that I pay a shipping fee of £200 that he would pay me back on top of the sale price if I would be so kind as to give him my bank details.

A another good reply is to simply tell them that the email they have sent has now been forwarded to the police and thanks to a hacker friend you have also sent the personal details you have obtained, works a treat.

I still can't believe that there is any doubt that these are scams! Its so bloomin obvious! Why would anyone pay more for the car? Any serious buyer uses the phone not email! Also, never consider people from other countries. Its quite simple.

I hear you chap, i can understand just relaying what Autotrader say. the only issue i'd have with it would be whether or not the car was cold. Top tip when looking at a motor, watch it start from stone cold, a hot engine might imply someone has warmed it up for a reason!
