Default NEW CAR REJECTION

Has anyone on hear managed to succesfully reject there car back to the dealer through faults not caused by them selves


If not, is there anyone who knows anything about rejection proccess, if so, could they get in contact with me as i have been given some advice and im not sure if its true or not

successfully rejected a puma once. long drawn out process and only after the dealer had numerous attempts to fix problem.

money back in the end though less a cost per mile for the use I had had out of it.


lost about £600 I think for 1 years motoring...

I think that I heard somewhere that you must let the Dealer try to fix the fault. If he fails and the car cannot be repaired then it is the phrase (not fit for the purpose intended)

i have, numorous times, and its been to 2 different dealers to try to solve this.

Interesting thread - bought a scooby in cardiff last year (on a wales thread on here) have a prob with it & dealer keeps saying nothing wrong even though other garages have said there is - let me know how you get on

A major insult....


My reasoning for posting the thread mailny was to see just how many problems come to the surface, letters have been sent along with details from other threads to the big motoring orginisations now. If its ends up costing me, im going to make damn certaiin that i am the biggest pain in the **** i posibly can be to the dealers involved, and subaru UK. My only hope, that its a big pain, but there attitude to date in trying to rectify problems, i really dont think they will be to bothered either way

Hi john, successfully rejected an ex demonstartor that was sold after being a right off, was repaired in-house.

LONG drawn out process, took 8 months, and of that the dealer had the car 6 months of that.


here are some links you WILL need

very helpful, if the garage is a member then they will get involved.

Also you must get in touch with the head office of the garage, in our case it was a volkswagen so we were dealing with VW UK and also the garage head office which was SYTNER.

COpy all letters to all parties, you must deal with the 'dealer principal' of the garage you have probs with.

If you want to email me, i'll let you have copies of correspondence etc.

In the end I got my legal cover on my house insurance to take it on, although it didnt get that far.

The dealer principal came on the phone giving it 'my solicitors are bigger than your solicitors' and saying that 'my local family solicitor would be out of his depth' and I informed him that actually we had a solicitor who dealt with 'breach of contract' and 'litigation' heehee, which we did.... paid for by my house insurance!!

THE MOTOR INDUSTRY SHOULD BE REGULATED TO KEEP COWBOYS OUT!!! Although we bought an ex demonstartor from a main VW dealer part of the Sytner group and it was a right off!! confirmed in a written report by another vw main dealer garage

I have been given a plan of action so far, and i just need to check that its the way forward, as i really cant afford to do something that may hinder my chances of gettiing the car rejected in the end

Does amaze me how many dealers will try that sort of thing. Remember on a second hand (but warrantied) car I had many years back, big end failure a week after buying it. Dealer insisted it was "because you kept over-revving it", telling everyone else "you know how it is with young drivers". I asked him to confirm that in writing, in front of witnesses. He said he would, at which point I asked what his warranty was going to do about selling me a car with a faulty rev-limiter in the ECU, which had clearly in his opinion led to engine damage. I got the full engine rebuild for no charge after that.

I do also know some companies who are very keen on the "our lawyer's bigger than yours" deal. My brother had that after he was sold a new mini cooper that was an absolute dog (bought new, made 2k miles and fatal failures from both seats, 2 steering racks, 1 gearbox, both front seats and about 15 other things) - the dealer and BMW UK refused to do anything, even after various threats and one of the car mags offering to get involved (which by the way can be worth trying, some dealers prefer not to be named and shamed, some mags enjoy the publicity from the fight!). Moral to me was simple - never buy a new BMW, particularly a new mini.

Anyway, good luck with your problems, hope you put them straight. If not, just publishise verifiable facts (so you can't get done for slander/liable), and lose the B*****s some business!

God help them if this is still ongoing when the new reg's are about to come out.

I will be paying a visit every saturday and sunday to make my gripe well known to the dealer, and whoever else just happens to be in ear shot of the continuing situation

Very interested in this thread....

I bought my 02 STI (uk) from Subaru dealer 3 weeks ago.

I picked it up Friday night, returned on Saturday am with tappet noise. They replaced half the cam buckets (one turned out to be cracked !) and the shims (engine out). Also, they had to replace the clutch, as it wouldn't re-assemble. They also fixed the radio and one of the rear windows at this point.

2 Weeks later, I picked it up - the CEL was on. They'd damaged the upper O2 sensor and had ordered another. By Tuesday, a wheel bearing had gone - and another window had failed. Returned it Wed. and picked it up Friday (yesterday). So far so good, but I've had a specialist take a look at it and the cam cover, on the side they fixed, is leaking oil, a d/p heatshield is missing and the uppipe heatshield is cracked.

I've spoken to them about returning the car under the 'exchange' program if another fault develops and they're making the right noises at the moment - just hope another doesn't come, then I won't need to test it....

Oh - and for good measure, after I collected it yesterday, I later discovered that the locking wheel nut key is missing - !

I'll be taking it back in a month or so, if nothing else fails, to get the oil leak fixed ........ NOT really what you want from a new car !

How long have you had it ? I've informed the dealer that the 30 days/1000 mile exchange service starts NOW, as its been in there garage for 16 of the 21 days..... They've accepted all this so far and have been pretty reasonable about it - fixing stuff asap and providing a car etc.

Put that in writing ASAP, keep a copy and then send it RECORDED delivery so that you have proof they accepted it,

Also, at the bottom of the letter, tell them you want them to acknowlage the reciept of your letter in writing with in 7 days....


This will cover you should you need to take it further...


DO NOT be fooled by them making the right noises though, it may well be genuine, but more often that not, they are telling you what you want to hear

IIRC 6pot had a long winded battle over a new Legacy with dodgy bodywork.

Think the dealers may have won though (not sure if thread still exists...you know SN legal blah blah )
