Hi Guys..

Some of you might remember about my dealings with Central Subaru..

Well.. I'll keep it short.. I ordered some stuff off them... they sent the wrong stuff... I spoke to them about it.. they said return it for a refund... which I did.

But I havent got my money back... after numerous phone calls...emails to them.. and false promises back from them, I decided to take them to court.

The proceedings have taken ages (down to crap service from the courts).

The current state of play is that the baliffs went around to see them at the address stated on www.central-subaru.co.uk (same address I sent the cheque to and the returned parts).

The baliffs were told that "Central Subaru Ltd" arent based there and it was some "other" company who was there.

I have checked on Companies House and:

CENTRAL SUBARU (WEST MIDLANDS) LIMITED
C/O GRIFFITH & GRIFFITH
CANTERBURY Hse 85 NEWHALL ST,
BIRMINGHAM
B3 1LT

That is the address according to CH.. notice the C/O part.. weird

But their website lists:

Unit 2,
Ann Street,
Willenhall,
West Midlands,
WV13 1EN.
U.K.

The baliffs cant revisit until I clearly identify "who" they should be seeing... I think Central Subaru are being crafty and using trading names, etc.

I knew I should have gone down to see them.

Anyone live in Willenhall.. want to pop around and establish who lives there ?

If not.. I will have to myself...

ps - Central Subaru (or whatever they are called) are A-holes!!

You also have to remember that when the bailiffs do move in they have to give notice I believe it's several days, which gives them time to remove anything of value.

You are right the court is an *** and even when found in your favour there is no structure in place to enforce payment.

In our case (dodgy dealer saga) it was the element of surprise, pitch up on doorstep and refuse to move until you get your money.

I'm sorry I know how frustrating this can be I hope it gets sorted out.

You should have paid by credit card and got them to sort it out.

Think about it

Mr Baliff turns up "excuse me sir I'm coming round tomorrow to sieze goods"

Dodgy Dealer "ok guv I promise not to move anything of value away"

Mr Baliff "thats good of you see you tomorrow"

Dodgy Dealer HA HA HA

No really the baliff will turn up and take walking posesion of all goods he will then note items he considers to be of sufficent value to meet the claim

If the "dodgy dealer" claims they are not his/Under finance/etc
He is given 24/48 hours to prove this

If these goods are removed during this period the "dodgy dealer" can and usually is prosecuted for contempt

failing the above the baliff will remove the goods then and there

Good point about Credit Cards though

Hi having had a fair amount of dealings with central subaru,i popped in today to mention the bad press they were getting from a disgruntled customer,apparently the items you ordered where 4 pot calipers,the correct items were sent,but when you returned them strangly the off side caliper was not the one that was sent, the one returned was found to be siezed and not wrong as you stated in your post on here,there seems to be a breakdown in comunication between the two of you,i have always found central to be helpfull even when there is no money involved,freely giving advice to anyone who needs it. Perhaps there prices are a tad high on occasion but with a little negotiation things do get better!
I live quite local to them and would be more than happy to mediate this awkward situation if it means there reputation and your wallet are left intact!!

Thanks for the mail.

The way it has happened, is that I wanted 2 pot rear calipers (aka Type R items).

I contacted Central and they informed me they had a set, but I had to purchase the front 4 pot items too. I double checked with them that the rears were infact 2 pots off a type R. They confirmed they were. But to be doubly (sp) sure I detailed everything on the order I faxed them. I ensured it listed two pot rear calipers (to cover myself, as I know how rare these calipers are, and how some companies dont know the difference between two and one pots).

Anyway.. the box eventually turned up after quite a delay... I opened it and discovered the rears were only single pot, suuprise, suprise. So I returned them, in their original box.. I didnt even remove the brakes out of the box when I discovered the rears were single. So I am puzzled how they can claim I sent a different caliper back ?

Anyway.. I called numerous times, always being told someone else was dealing with my refund, or such-and-such could only write the cheques, etc...

Hence why they forced me into a situation that I had to take some legal action.

If you could "liase" with them to obtain my refund, I'd be extremely grateful.

If they require my details... or a copy of the order then let me know.

I will speak to the man concerned tomorrow (andy)by the way.
It seems i was told half a story he told me most definately that it was front calipers only that you ordered and that you sent your original dodgy one back!
But being the mediator?!! that i am!! All we are concerned about is getting you a refund unless i'm mistaken?!
So leave it with me and I will do my best to sort the situation out

Griffith and Griffith are probably their accountants -- that way all the bumph from Companies House goes to them and Central Subaru don't have to bother with it.
