Technically it is likely to be 'dangerous/insecure load' which is 3 points and £60 .... reality is probably being told it is an offence and you can have a ticket or make the person in the back walk.
Most people take the option of booting out their mate rather than take the points ........

It may seem 2 b a laugh at the time, stacking loads of mates into your mota, but jeepers its not half dangerous!
Ive been unfortunate to be at the scene of many a fatal road crash, some of the worst being with too many crammed into the vehicle or simply not wearing their belt.
Not trying to preach to anyone, do what suits yourselves, but I hope we never meet in those circumstances! It sure is no laugh then.
Cheers.

My first car was a Fiat 500, and one night at college, we managed to get 6 in that..... 3 up front, and 3 in the back... if you've ever been in one you'll understand just how difficult that was....... only drove about 1/2 mile... and was pre seat belt laws....... the only way out was through the roof!!!
