I'm pretty sure the gearboxes are a known weak spot on these cars (or was it the diffs?).
Is it from a dealer? If so, I wouldn't accept delivery until you know for sure what the problem is and how many milions it'll cost to fix.
EDIT: check the transfer box works too i.e. shifts between 4WD/2WD hi/lo ratios and shifts back.

Having thrashed a 4.0ltr Cherokee for 2 years I can honestly say they aren't weak.
It does sound like the classic filings in the box though. The filter gets blocked with shít and the drive slips when warm.
I had a BMW do this. One service later at a specialist auto transmission workshop, it never did it again.

its possible that a sensors conection is loose or dirty but you would have to get underneath and check
3rd gear is limp home as you say
a blown fuse may do the same
