Angry RIGHT EE - YOUR TURN!!

I've been struggling with a faulty phone for a few months now.

Took it back to ORANGE/EE for repair - they kept it for over 3 weeks.

I picked it up last Sunday, repaired so they said ...... the fault has returned already!

I'm going to reject the phone and demand a full refund, it's 11 months old .... what are my chances?

The mighty DSG have fallen by my sword - will EE treat me any better, or will i string them up too?

If you are dealing with a shop then try.

Over the phone they are a complete nightmare. I'm quite good at complaining for unreasonable things but Orange are just terrible. They agree to something to get you off of the phone and then make no notes on the account and fail to take action.

I'm aware of ORANGE and their non Customer Service ....... lieing, to them, seems to be a natural way of proceeding.

I've allowed them to repair it, they've failed - I think I can reject it.

It's an Orange Sydney and when you text, only the first character comes up .... ie. if you hit A 3 times it doesn't come up with C .... but 3 A's! All the keys are the same.

The Orange Shop tried to get into the Calibrate Screen Menu - but couldn't ..... I don't even know where that option is!!!

I know with T-mobile you have to give them 3 chances to fix the fault before they will replace the handset.

Why did you buy such a pos phone, thirty quid no name rubbish, just get a refund and spend on a proper phone, you like to tell us how fantastically wealthy you are but buy sub standard "bargains", even those Apple things will send a text, ok it will say something completely different to what you wanted but it is a step up on this.

I belive the 3 try rule is legal for every item sold. Take it back and say it's broke again. Say you have lost all faith in the company and would rather a refund.

Better than reasonable if you can provide an independent report, stating that the fault was there from manufacture. Within the first six months they have to prove that it wasnt, which is harder and seldom attempted.

Id expect that you will have to actually do it though, in this circumstance. Pay for the technical appraisal and write including the report and requesting a full refund (inc the cost of the report). When they reject it out of hand, as they probably will, write back giving them fourteen days. When the fourteenth day is up start proceedings online. If they dont fold immediately then they wont show up.

On the three counties radio show (jvs) the presenter is always saying that the shop has 3 attempts to fix / replace before a full refund can be issued. Obviously the shop can refund earlier then this if they want.
- tried looking for a link but it was getti messy.

Well, took the phone back today.

They can understand my frustration, but - as the Manager isn't in today - there are a limited range of things they can do.

They could give me an 'upgrade' ... which I will pay for, of course!

Anyway, Manager will ring me tomorrow ..... to discuss the options they wish to make available to me.

I'm a little unclear of my rights ..... faulty phone, they repaired but it didn't cure fault.

I have had the phone for 10 months, warranty is 12 months.

How long is the 'expected' life of a phone? 5 years? ....... if that's the case I have had less than 1/5th of useable life.

It's a **** phone - and I shan't be sad to see the back of it - what would be a 'reasonable' settlement?

They pay me £30? They fix the phone again? They give me a re-furbished phone of the same spec? They allow me £40 off an upgrade?

Sales of good acts ? Fit for purpose - how long would you expect a phone to last for ? Even a £30 one should last more 10 months !

There's a Which app which tells you what your rights are. Seeing as you dont have a decent phone anyway and that the one you did have doesnt work. I would suggest that you find some one with a phone and get them to show you the detail on the Which Rights app.

Any product should have a satisfactory life span, forget 12 months warranty.
You are within your rights to ask for replacemet or a refund. As you already know take the case up with your local trading standards. You can only reject something within the first 6 months.
The app is excellent and lays out what your rights are under the sale of goods act.

If that AAA stuff happens, then it sounds as if you have Predictive Text on - rather than normal texting. (Probably in "Smart ABC" mode - you want "ABC or "abc")

Dr.No ... thanks for that, I have turned that off - I hate predictive Text so that's the first thing I do.

In any case, even in the address book it won't work ... for example, wanting to phone Les ... hit the J,K,L button 3 times - result? JJJ!!!!!! So Jim is selected to ring!!

You don't know how f**king annoying it is!!

The Manager of the shop rang me this morning, as promised ..... guess what? He cannot do ANYTHING by way of a replacement phone, a deal, refund - I asked him what he could do as Manager - his answer? NOTHING!!!

He said that ZTE, a 3rd party where they send the phone for repair, have a Policy where require him to carry out at least 3 repair chances before exchange - I said that I'm not interested in what ZTE think, say, or do - just EE (Orange).

I said to him he must be so pi55ed off that he has the same power as the 13 year old Saturday boy!!

Anyway, he suggested I ring Orange Customer Service ...... I suggested that he do that and get back to me with an option - he said he can't do that without me being beside him in the shop due to the DATA Protection Act - I informed him that he was talking cr4p ...... but, he said, it's Company Policy!

Why can no-one these days actually do anything?

In the end I have contacted Customer Services who asked for one more repair chance and then I get a new phone if that repair fails ..... I've agreed to that as it's over 6 months old and the other options will cost me.
