Fixed Penalty Notice

Fixed Penalty Notice
Had a good day today not...(although my own fault).........got tugged by an unmarked BMW on the Motorway. He said they had 2 seperate readings, one for 92 mph and one for 95 mph
Said I was a lucky boy cos he would deal with it by way of FPN using the 92 rather than the 95 which he says would have been a court appearance and an instant ban.
I was happy to accept the 3 points and £60 but explained to him I didn't have my photo licence card or paper bit cos I had sent it off for renewal of the photo on Thursday.
It's looking unlikely that I am going to have it back in time for the 7 days to produce it at the station. Anyone got any ideas what happens next? I've looked on the Internet but I coudln't see my exact situation i.e. I've sent it off to get the photo renewed cos it has to be every 10 years.... I haven't lost it.
I really want to avoid going to court as I know its def going to be a more expensive trip!

I renewed mine recently and I had a bit of paper in it advising what to do while your licence is off for renewal...unfortunately I cannot put my hand on it but will look again later.

25mph over on a motorway isn't an instant ban, just more points.

This 2 readings and "I'll use the lower one as way of a fixed penalty" trick was played on me too, it's the officers way of dominating you and making you feel ever so grateful for what is him butt raping you.

It is a separate offence fail to produce documents within 7 days. Take your ticket to police station and explain your licence is at dvla. This can be checked on pnc to confirm. The officer was more than fair in issuing a ticket as if you go to court I'm sure you will be far worse off.

As far as the licence is concerned do as much as you can. Toddle along with the insurance, MOT etc and if possible proof of renewing your photocard.
If after that they want to proceed and charge you, well, they can. Can't see it getting very far if you then turn up with the driving licence later on though.
If you have produced the licence in your best time, it then shouldn't go to court. There are always cracks in the pavement and arseholes to deal with though...

Classic trick!
Anyhow, I had a similar issue a few years ago. Got tugged on the bike as it came up uninsured.
What had happened was that they'd put the wrong reg in by one digit. It took a while to sort as initially the insurance company said it was my fault. Took them a while to listen back and realise I'd given them the right reg in the first place.
Because of this I was going to be over the 7 day allowance so just went to the cop shop and they spoke to the PC who issued the producer and I was granted another 7 days to sort it.

Whatever happens, try to avoid going before the magistrates.
They will assume you are guilty as charged.
I tried this.......my witness, who I could have PROVED lied in his statement, failed to turn up, and I was told that this was "hard luck".
THEIR three wits turned up.
I got £100 instead of £60, FOUR points instead of three and £150 in costs.
They were going to hammer me with the fine, until I told them that I would go after the court for damages if their fine caused my marriage to collapse, since it was ME on trial, NOT my wife, why shoule HER earnings be taken into account?
Just be careful with mags: they are a PART of the scam, they are a part of the problem.

....mate I sent my license off to be renewed via the Post Office. DVLA recieved the application the same day, and posted my replacement license the next ! I know they say it can take two weeks but I got mine within three days. Hopefully yours will be quick too. However when I handed my old one in the Post Office gave me a reciept just in case I needed to produce. Hope this helps !

I lost my wallet with licence in it about 3 months ago, contacted DVLA to get a replacment and was asked if I really wanted one. I asked why and was told that since it was up for renewal in 2013 and because they could confirm I hold the licence there was little point replacing it until the renewal date. I asked what would happen if I got a producer and was told again it wouldn't be a problem as my details are on the system anyway.
I replaced it anyway cos I could see potential hassle, but that was DVLA advice to me.

New licence turned up in the post today (impressive turnaround!) so I can toddle off to the station at the weekend and accept the fixed penalty notice. Phew
Thanks for all the advice though it really helped when I was getting slightly cheesed off about the licence angle!

If a policeman waves you through a red light (pelican crossing) because of an accident ahead, and there are cameras on the lights, can this be appealed if I get points and a fine through the post??
It happened last night and this is on top of getting 3 points for speeding a couple of weeks ago. Really don't fancy going from 0 points for 20 years to 6 in less than a month
