Swift justice

the government is set to place people's right to defend their property, long present in common law, in statute law.

"It's quite obvious that people are entitled to use whatever force is necessary to protect themselves and their homes," Mr Clarke said.

Asked about what this would mean in practice, he said: "If an old lady finds she's got an 18 year old burgling her house and she picks up a kitchen knife and sticks it in him she has not committed a criminal offence and we will make that clear.

He added: "We will make it quite clear you can hit the burglar with the poker if he's in the house and you have a perfect defence when you do so."

This is very good news, i really hope that the government don't flake out at the last minute and cancel this.

Labour already said they were going to change it and never did!

Good news. Common sense prevails. Labour made it so the Criminals had more rights than their victims.

Doh! The EU have just waded in, European Convention on Human Rights has been contravened and over rules common sense, madness will have to be restored...

Justice is set to become even swifter following a Judicial Review on 24th June this year. Police will be able to bail someone for no more than a total of 96 hours, including the time they have already spent in custody. Great news for rapists / burglars /pedophiles / etc who will be released without charge pending new evidence coming to light. ( In effect offenders will be released without charge after initial interview, free to do as they please and contact who they please. When the forensic or other new evidence linking them to the crime becomes available, police then rearrest and the 24 hours starts again. While on bail they can continue to rape / steal / abuse. Please forward your thanks to Mr Justice McCombe in the High Court. British Justice. Best in the world...

I think its ok to attack if they are in your face, but if they retreat and you chase and beat the sh.t out of them then you will be in trouble

Using no more force than is necessary in a nutshell.
Retribution is the "grey" area, eg burglar running away being shot in the back, no weapon on his person, no threats of physical violence made, does not constitute self defence .

hence why tony martin was convicted of murder (reduced on appeal)

it was the fact that Barras was shot in the back, attempting to escape that was the damning evidence

I always like the American system... they take the idea of 'outlaw' seriously. If you burgle someone's house you are effectively an outlaw; which in this case means 'outside of the law' or more precisely 'outside of the protection of the law'

You break into someone's house just have no protection in the eyes of the law for what the householder may do.....

When the hell did I become so right wing????

plenty of innocent people get shot in the US for accidently "entering" the wrong dwelling, whether thru drunkeness, stupidity, mental illness, mistaken identity (you think it is your new girlfriends house) etc etc

an old wise friend once said to me "Hodgy with great power comes great responsibility"

I am not sure how responsible the majority of my fellow citizens are with that sort of power, maybe as another old friend said

"you gotta have faith, gotta have faith da doom da doom"

As someone who has been attacked in their own home I think this is a welcome move although it's too late for me unless they are willing to clear the criminal records of people who have already received assault charges while defending themselves.
