Sounds good, however if you own a piece of land or run a shop, pub or similar its going to be difficult to stop people parking on your propert.

I'm against the cowboys, but would it be better off if the whole thing was regulated like in the US?

In Windsor near the river a private firm clamps people left, right & center then charges the princely sum of £150 to release Private company rakeing (sp?) it in! I parked there once, stayed slightly over time & got clamped. Left the car there overnight, went back the next day & they'd removed the clamp to stick on someone elses car ... just got in & drove off

Surely there must still be some protection for private owners against those trespassing on their land.

Certainly the right move to ban the theiving clamping companies though.

A better answer would have been to impose a maximum penalty of £40 to release - with an independant appeals procedure?

Whoever loses the appeal pays for the expenses of it.

A ban on Towing vehicles away, or - again - just subject to the same £40 fine.

You do feel for the landowners in some cases ... and, in answer to the poster above, no private landowner is going to take people to court for trespass or to pay penalties/fines - just imagine a popular spot having 5 cars parked each day? Just imagine the legal costs of enforcement?

A physical barrier is the answer.

And why do companies, who are not working on a weekend, not allow members of the public to use their Car Parks? Maybe the Health and Safety aspect could limit their abilities to do this?

All in all, a great piece of Legislation .... let these bullies find another soft target (or, better still, get proper jobs like the rest of us!!!!)

Clamping has been banned up here since the nineties and there aren't any major problems with parking on private property I don't think. I didn't think it was enforceable in England anyway? Thought it was only the councils who could legitimately clamp you and force you to pay by law?
