Default Advice on phone contract

My missus got a Nokia 5800 approx. 6/7months ago on a 2year contract. The phone from new has been pretty crap and she had it replaced only for the same problems to appear, these problems seem to be pretty common after checking online. Now the phone is acting up again, won't allow itself to be updated and the battery lasts a few hours max!

Vodafone are willing to repair the phone again but to be honest my missus doesn't want the phone anymore as its been shamefully crap. Does she have the right to refuse repair and ask for a new phone?

Cant see theyll do much 7 months in , except perhaps new battery ?

Get another handset off of ebay ?

I don't really see why she should go to the expense of paying for a new handset. She got a 2year contract, I would expect the phone to at least operate at a reasonable level for the contract period.

Do you think with the evidence of many other people online experiencing the same problems with this phone would have any bearing on a result to get a new phone. It annoys me completely as her phone is unreliable and is absolutely useless in the case of an emergency.

if it doesnt actually work then she should get a new one under manufacturers gaurantee !

they've already told her they will repair it but not replace it.

Sale of Goods Act. Products must be fit for purpose if not then you should get either a replacement or a refund.

Voda have a lemons clause

If a phone is repaired 3 times for the same fault, they will replace / swap the phone

My N95II went u-s (gps unit) all they kept doing was a SW flash - the GPS unit is HW

After 3 repairs, i contacted them, and they agreed to replace the phone

I took an omnia instead

great Mark, thats good to know as with the replacement having the exact same fault as the original, I think getting thru another 2 phones shouldn't be hard in order to get a new phone that works!

02 have the same deal. Repaired too many times and a replacement is offered, though usually the same model.

had that with my crappy LG viewty and after 2 repairs, they just sent a new handset
