Default Pothole Damage

Evening All

Managed to hit a nice deep pothole on the way to subway earlier in the dark. Steering feels a bit funny but just hopefully just tracking or balancing.

Anyone had any luck making a claim for the council for damage?. Not worried if its just tracking or balancing but if its fecked something up i wont be happy.

Found this site Potholes.co.uk - How to claim anyone know much about it?.

Just get fecked off paying tax for anything and everything and our roads are in appalling condition.

It is hit and miss, after doing what it says to do on your link, are your confident to stand in front of a Magistrate and state what has happened.

Unfortunately, most are not, but if you are to pursue it, you ultimately need to think that you will have too. Local Councils are aggressive in terms of dealing with enforcement and in my experience will not back down to any request, so your only recourse is a layman.

Btw, they will not dictate if any party is right or wrong, you wont pay costs (apart from the initial claim, which you (can/will) claim back) All they do is make Judgement on the current laws.

had this last year in my lowered mg zs. didnt see it coming just seriously felt it. took pics of the hole and pics of the damaged they said they'd repair to hole but nothing about the car. ended up repairing myself as didnt think id have much luck? but i did have photo and witnesses. little old lady saw it and her face haha such a picture. then went into an hour rant about the council lol. if you have any luck let me know i might just go back and complain again.

Witnesses will not be taken into account, in regards to this in a Small Claim, nor will it over, I think, 4 months from your initial complaint.

Edit: might be 20 weeks

I am definitely not an expert on this, just work in a particular field that requires it.

thanks guys, going to get it checked out today and if its more than just the balancing or tracking will see if i can take the case further. certainly prepared to go to court for it as something needs to be done about all these potholes as its pathetic really.

keep you posted and will try and get a picture of the hole later.

doesnt help having low profile tyres and hard suspension either really.

Our roads are a disgrace and I know the recent cold spell has done it's damage but it's only done so much damage because of the poor state they were previously and the penny pinching poor repairs that have been done in recent years. I must look like a drunk drivers the way I have to swerve along some roads.

Very true.

Almost all of the road repairs round here aren't done properly either (be it from prior potholes or services digging a hole), where either the overlay is too thin, or the hardcore is too soft. And almost none have the joints sealed with cold pour, so water ingress will break up the repair as soon as it freezes again.

Surely there must be some sort of code of practice or BS/EN standard that repairs must be done to, and if so why aren't they being done proerly? I'm not a paving expert, but even I know how to properly repair a pothole in tarmac - and yet I see repairs that are quite clearly bodged and not done properly (hole basically filled with repair tarmac and levelled with a wacker, nothing else, no cutting, no digging, no priming, no sealing ).

Noticed loads around this way now, i suspect the snow ploughs must do some damage?

Seamed fine before the snow came down?

Surrey seems to be one of the worst for crappy roads at the mo. Some of the 'potholes' are more like craters. I'm so happy I pay my council tax for substandard bin collections, cruddy roads, non existent policing etc etc etc!

well, I'm pretty used to it already, unfortunately. Surrey had some of the worst roads before the cruddy weather!

Gonna have to buy a jetpack, now that's commuting for the future!

I'm in Surrey but not far from the Sussex border. Difference is like night and day as you cross the county line. Its getting impossible to miss them in some places now.

And yes stupidly high council tax for little more than a fortnightly bin collection.

My left front wheel hit a stone which was projecting into the road and was in fact surrounded by tarmac where it was in the road. I was forced to the extreme left of the road by an oncoming monster lorry. The tyre was destroyed.

The council denied that they were responsible even though I pointed out the dangers of the stone.

I would have had to go to court to get compensation.

I busted my front Tyre a few years ago from hitting a pothole, I did the following and the council paid up for both new tyre and tracking!!

Took pictures of Pothole and location
Got car fixed
Sent Receipts and letter of complaint asking for payment to be made
Met Council officer at the pothole location, which were at this point filled in.
Received Money for tyre and Tracking.

Good Luck

Ps that was Beds CC I complained to.

I let the wife use the car last year and she hit a sunken grid which threw the car against the kerb. I chased it and got completely fcuked off by the local council. I suppose it will all depend how much money they can afford to pay out
