Default Sucker or Bargain

I've just bought 2 somethings outside of auction from a seller in the US.

I paid him $1075 for these items. They are £499 each here.

.....I've not heard squat since I sent the money Saturday night.

ooops.

I'm off to San Francisco on Sunday, so if he is around there feel free to mention that someone will be coming to check on the status and perhaps pick them up ...

......Paypal.

I've got all his details, phone number etc.....but I'm still worried.

He'll be based in west US, so I was expecting an email this morning with a tracking number....but nothing.

He is a powerseller with 1000 positive feedback so I "shouldn't" have to much to worry about.

Paypal dont release the money to him until there is positive feedback from you. Buying outside the auction may change all that though.

Was the money sent as "Gift" or for "Goods"

As goods, you might be able to get paypal to refund you if no proof of delivery is available.

As gift, the money is gone.

In this country the items are £499 each. You paid $1000 so just over £600.

Does that include delivery? Are paypal fees on top? As gift you have to pay the fees. Plus you have duty and VAT to pay if customs pick it up. You'll probably save £100.

If they got through customs it would have been worth the gamble.

We now know it wasn't. I've still not heard anything, yet the guy is still responding to emails from his ebay shop.

I've got his phone number....but he never pics up. Countless emails, not one response.

I've opened a dispute with paypal....but I'm not sure what else to do.

I'm going to have the write the money off in my mind, and buy some more. If I get them, or my money back then it's a bonus.

The paypal dispute seems to work

From Buyer - Davyboy

10/12/2009 07:05 PST

I had recently agreed to buy 2 sets of motocross knee braces from this ebay seller.

He has his own ebay shop, his feedback is very good, what could go wrong?

When I finally made my mind up and arranged the funds, the auction had ended. However, the seller and I were in regular contact by this point and he agreed to send me an invoice for the goods.

This was on the 5/12/2009 and I paid the invoice immediately.

Since this time I have been in contact daily via email and in the last 24 hours by phone to try and get an update. I have heard nothing since paying.

I appreciate only 5 days have passed, and I still want the goods but the distance and amount of money involved makes me feel very uncomfortable.

Thanks

From Seller - DMXS Sales

We just got your email today for the about the braces. it has only been 5 days and we are in a different country. Your product would not be to you until at least another 5-7 days. I under stand you uncomfortable about the large amount of money for products far away from you. But you understood we were far away from you when you made the purchase. That is the nice thing about paypal you are protected. But at this point we need to prooctet our self's and cancel the order. We cant afford to send out product that is now not paid for. We have no emails from you in ebay that you have contacted us as well.

Thanks

From Buyer - Davyboy

I have no problem waiting for goods, I am aware of how long things take to order from the US as I have done it many times before. But the the lack of communication was not acceptable.

I've sent you several emails to several email addresses, these all seemed to reach you OK before I sent the money. I've also tried calling the number on your website at least 10 times over the last 2 days. These calls always go to the answerphone service.

Clearly the goods have not been sent yet despite your claim that the goods will be shipped within 24 hours, therefore cancelling the order is best resolution.

I look forward to the money returning to my palpal account. All $1075 of it.

Regards

Just to brighten up your day, any item passing through customs worth more than £38 will be subject to taxes, gift or other wise..... Sorry...

How would they know it was worth more that £38?

Are they going to open every single box and inspect for an invoice?

Yes they are used to valuing goods and hardly anyone gets away with it these days.

Also expect a £25+ handling fee from parcelforce at this end if they have to handle it..
