Default damaged parcels

Just had a boiler delivered, I got it off the postie went out, got back and unwrapped it

massive dent in it!!!

I emailed the place I got it from (germany !) and they say I should have checked it before signing for it

is this right

they have offered me a bit of money and hopefully it will still work

If the dent is in view ie not boxed in, the company who built it should sent you a new case/panel.

I worked for ten years at Baxi/Potterton/Myson and we were forever sending out casings kits through transit damage.

this an euro type water boiler, it is the casing but not changable but is in view

offered me a quarter of the price

I sign my name with "unopened" next to it....... However sale of goods can be relevant for internet (?mail order too) purchases to return within 7 days no questions asked. Suspect quarter of price sounds good for cosmetic issue?

Except the DSR ( Distance Selling Regulations ) don't apply to overseas sales, and Germany has some very strange laws about mail order stuff - you will basically never get a refund or replacement from a German seller if something is damaged in the mail.

Saying you should have checked is a bit of a cop out, as how many of us actually make the postie or courier wait while we unpack something ? Wouldn't make yourself very popular doing that !

If you aren't bothered about the dent, then I think a quarter of the price is probably about the best offer you'll get - the only other option would be returning at your expense, which you won't be able to claim back from the seller, and hoping they give you a refund as they are unlikely to send out a complete replacement unit because they would have to pay for the shipping costs again.
