If i hand my notice in can they take my car off me
I have been offered a new job and have to give my current employer 1 months notice. My question is if i hand in my notice i think they will put me on garden leave for a month as i am a sales rep and they would be worried about me giving them a bad name. If i was on garden leave could they take my car straight of me or do they have to let me keep it till the end of my notice period.

i would hve though if you pay tax in your wages it will be your's till your leaving but if you don't it can be from when you hand your notice mate if they want as it's theres not your's .

I would imagine there are all kinds of reasons why they cant, but the honest truth is they probably will. And if they do would you bother following it up through a civil court?

Read your employment contract. I know mine states that they can 'take back' my company car AT ANY TIME in my employment, at there discretion. That small print in my contract means I'd be screwed in your situation!

I don't really understand this gardening leave, if they do put you on it, then why can't you just go and work for the new employer, if your existing employer doesn't want you there for your notice period, why would they want one months notice?
Would they not just let you leave with immediate effect?

Garden leave means they can call you in to work at any time during that period if they need to. You need to be available to work, i.e. not off on holibobs.
Retaining the car is likely to be at their discretion but I'd expect to keep it as long as you were on gardening leave. Should they terminate your employment immediately by paying off your notice period then you would not need to be available and could not retain the car.

It depends on the company. Some let employees keep them. I've also heard of companies taking back cars, but making a payment to compensate for the car not being available to the employee.
