I reckon Satriani's definitely got a case, bearing in mind that the Stranglers successfully sued both Elastica over lifting the riff from "No More Heroes" and The Manics over "If you tolerate this" being pinched from "Duchess".

Both alleged thefts were far less cut-and-dried than this one. At least to my ears.

I don't think that just the similarity of the chord progression has any relevance - you need the combination of the chords and the melody to make a case in my view. Otherwise every blues band in history would be suing each other's ***** off all day long.
