Default Corporate bonds - taxation

If you lend money to a company by buying their bonds, can it be (legally) structured so that you are making capital gains rather than income for tax purposes? I want to make use of CGT allowances rather than income tax, and don't necessarily want to buy too many more equities.

If you exceed the CGT allowance do you still pay tax at your marginal rate of income tax or has this changed this year?
